* DC - Slowdowns plague ACE ahead of next phase this weekend


-- Slowdowns continue to plague U.S. Customs and Border Protection's new electronic filing system, just days before the system is expected to onboard its next round of filers... Even after the federal agency said it was able to remedy the glitches that riddled the initial rollout of the Automated Commercial Environment, or ACE, in early April, “outages” and “network issues” have routinely been reported via the agency’s Cargo Systems Messaging Service... The ACE system was designed with the intention of streamlining cross-border trade and allowing shippers to easily share trade documents with government agencies, saving time and money... Fany Flores-Pastor, director for research development at global logistics software developer Descartes Systems, said there are concerns industry-wide that while Customs is attempting to be responsive to filers’ issues... Customs, after all, is under its own deadline for full ACE compliance by December of this year — a White House mandate for the federal agency... As of Saturday, foreign trade zone, or FTZ, filers will be required to file entry and entry summaries in ACE... Early april saw a roughly 50 to 100 percent increase in the number of filers transmitting data via ACE... May 28 was originally set to be the deadline for no less than a dozen PGAs. Those PGAs will now be required to file and have their corresponding shippers file in the ACE portal later this summer on an as-yet-unspecified date, according to Customs. BUROCRACY DELAYS * Australia: Long wait for trucking to get permits approved

* ACT - Most delays due to the regulator waiting on local and state governments

-- Many trucking operators are still having to wait weeks for heavy vehicle access applications to be approved, due in large part to state and local governments... Figures contained in the National Heavy Vehicle Regulator’s (NHVR) 2014-15 annual report show permit processing timeframes are still sluggish under the Heavy Vehicle National Law... The report says it took an average of 23.48 days last financial year to process permit applications, but only 4.34 days of this was due to the NHVR... Most of the time taken to approve permits stemmed from the regulator having to wait for local and state authorities to provide consent for a truck to access their roads... Under the HVNL, local and state governments must give their consent for access before the NHVR can begin processing the relevant permit... The HVNL sets a 28-day limit for local and state authorities to provide their consent... The regulator's annual report says local governments took an average of seven days to provide consent when doing so within 28 days, but it is a different story for state governments... State road agencies granted 704 consents after the 28-day limit and averaged 65 days in doing so, while the average for local governments after 28 days was 59.9 days (813 consents)...

Butch Brown reportedly told AASHTO conference attendees that LaHood and his administration “don’t have a clue what’s going on”

Jackson,MISS,USA -The Associated Press/The Trucker -9 Nov 2010: -- Butch Brown, executive director of the Mississippi Department of Transportation and outgoing president  of the American Association of State Highway and Transportation Officials, (AASHTO), says he is preparing to undergo medical procedures for a recurrence of prostate cancer...    Brown’s pronouncement comes a week after he admitted to erring in a speech in which he was sharply critical of U.S. Transportation Secretary, Ray LaHood...   LaHood and two aides canceled scheduled trips to Biloxi last week to speak at a meeting of Southeastern highway officials...  The nation’s federal highway administrator sent a stinging letter to Brown calling his behavior “shameful” ...  Brown told the Mississippi Business Journal and The Clarion-Ledger that he was stressed out, reeling from the death of his close friend Northern District Transportation Commissioner, Bill Minor, who died earlier that same Monday morning a week ago, and his own serious health problems when he made the remarks at the annual meeting of the American Association of State Highway Transportation Officials in Biloxi... Tollesboro,KY,USA -Truck Driver News/Thoughts from a trucker, by Jason -November 10, 2010: -- Why is it that the so-called transportation leaders are just like the three blind mice? Of course we know there are more than just three transportation leaders, but I couldn't find more than three blind mice. So we will try to focus on the three that I and many others think are the most important parts of the transportation "leaders". Why did I pick the NTSB, FMCSA, and the USDOT? Well, it is because these three are in the most power when it comes to dealing with the trucking industry...    NTSB investigates most of the really bad accidents that happen within the trucking industry, they are usually completely thorough with their investigations to determine what has happened. This usually takes them several months to complete a full investigation. If to many of the same kinds of accidents occur, then they will make recommendations to the USDOT and FMCSA. Then why do I consider them to be part of the blind mice trio? Well, the NTSB has a blind eye towards the people that are actually out here working every day the truck drivers. Drivers are over here jumping up and down waiving their arms wildly to try to get these leaders attention, but they never see the drivers. Drivers have been complaining about the hours they work, appointment times, sleeping arrangements, lack of healthy places to eat, and the lack of good places to park for years, but nobody will listen...  Primary mission of the Federal Motor Carrier Safety Administration (FMCSA) is to reduce crashes, injuries and fatalities involving large trucks and buses. With that being said, why do they also have a blind eye towards the industry? I know the administrations leader Anne S. Ferro has to have some idea about how bad the parking situations are. And she must know what the drivers are going through on a daily basis, as far as sitting so much at the docks. Prior to her being the leader at FMCSA she led the Maryland Motor Truck Association as its president and chief executive officer from 2003 to 2009. Previously, Ms. Ferro served as the State of Maryland's Motor Vehicle administrator from 1997 to 2003. Why is she and the FMCSA so blind to the real problems that truck drivers face. She has been involved in transportation for some time now so, it surely is not lack of experience. Instead of her taking the reigns and driving to better this industry she is allowing herself to be driven and enjoying the pay. The USDOT is completely blind to anything to do within the trucking industry. It is led by someone who has not been in the "real industry"� but has been a part of the House Transportation and Infrastructure Committee and we all know they have blind eyes towards the real problems. The only thing this administration's choice for leader of the USDOT is doing what he is told to do, by a so-called leader who knows nothing, and spending tax money on ludicrous livable projects, i.e., millions of dollars for bike paths and fighting distracted driving. I don't have a problem with him focusing so much on distracted driving, I do however have a problem as to how he handles the so-called problem in trucking. States already have fines and punishments for text messaging and driving and are no way near as bad in a car as they are for commercial drivers... But he insisted on quadrupling the consequences for the safest drivers on the highway truckers...  As example a trucker's comment: Why not quit wasting all that tax money on bike paths, and get us some parking places built !...  (Image from daniellecontarino: Three blind mice)

Defense Secretary, Gates, called the current export control system a “Byzantine amalgam of authorities, roles, and missions scattered around different parts of the federal government”...

Edmonson -Apr 21, 2010: -- The Obama Administration will consolidate licensing, control lists and data systems to bring export control system into a single office... Defense Secretary, Robert Gates, told members of Business Executives for National Security that the administration plans the reform in three phases that will consolidate all lists of arms, munitions and dual-use technology items, a unified information technology system to manage the list technologies, and finally a single agency to administer all export licensing... Under the existing system, export control is divided among the departments of Commerce, State and Treasury, with additional oversight from Defense. Gates said that senior-level officials in all the departments support the reform... In his State of the Union address in January, President Obama called reform of export controls a major part of his overall strategy to increase U.S. exports... "This is a perfect example of European bureaucracy literally gone mad"

Brussels,Belgium -Road Transport, by Justin Stanton -1 April 2010: -- The EU is set to legislate on the colours that can be used in truck liveries, apparently in an attempt to address the industry's safety record... The so-called 'Tricolore Directive' will effectively dictate that all truck liveries must comprise of three colours in equal measure - white, red, and blue. The EU would like the directive to be enforced from 1 January 2012... Danish MEP Olaf Prilo, who sits on the European Parliament's safety committee, offers this statement: "Certainly, improving the safety record of the road transport industry is a priority for us... What I can confirm is that we have undertaken research into the main colours of the liveries of trucks involved in road traffic accidents. Having said that, I cannot comment on the outcome of that, except to say the most 'dangerous' colours are clear and we will announce those soon... "It is too soon to be talking about legislation, though."...

Without it, the FTA says many foreign operators will remain "incognito" to enforcement agencies such as VOSA... That decision was made Wednesday after an air board hearing on the rules, which critics want to delay because of concerns over the cost of retrofitting and replacing the polluting engines...

-- Diesel-driven road users in other U.S. states on Wednesday hove their sighs of relief as California backtracked its diesel emission rules by delaying implementation... California, the only U.S. state having the right to adopt its own emission regulations, passed in December last year the toughest standards in the country and all the other states are allowed to follow suit or opt for federal standards... The Associated General Contractors of America estimated that as many as 32 states were closely following the footsteps of California in enforcing the first-time emission limits for in-use fleets of diesel-driven equipment... But in an unexpected policy turn allegedly prompted by the ongoing recession, the California Air Resources Board (ARB) has ordered modifications to the emission rule specifics worked out in April... If implemented without delay, around 1 million trucks and buses countrywide will have to be retrofitted or replaced altogether while some older models will have to be phased out in due time... Almost all the 50 U.S. states have to write their clean air "state implementation plans" (SIP) to show how they will meet the tighter federal standards... For the time being, 19 states are having air pollution problems similar to those found in California. And any state that fails to develop an "approvable" SIP can be subject to numerous federal sanctions including emission caps limiting economic development and losses of federal highway transportation funds...

NOT SO CLEAR AIR INSIDE * USA - The air board’s shame

Staff never revealed internal scandal before crucial vote

Sacramento,CAL,USA -The San Diego Union Tribune -November 22, 2009: -- On Dec. 12, 2008, the California Air Resources Board unanimously approved groundbreaking new rules governing diesel emissions. Members rejected complaints from the trucking industry about their heavy cost and from some academics who said CARB grossly exaggerated the health risk posed by the emissions... Soon afterward, a Union-Tribune editorial writer confirmed allegations that Hien T. Tran – the lead scientist and coordinator of the study used to justify the stringent new diesel regulations – had lied about holding a Ph.D. in statistics from the University of California Davis. Instead, it turned out, Tran had a mail-order Ph.D. sent to him from a “university” based at a mailbox at a UPS office in New York City – and that senior air board officials knew this before the Dec. 12 vote... Incredibly enough, air board Chairwoman, Mary Nichols, has pretended this is a minor problem... Tran wasn’t even fired, just demoted... This is not how a reputable government agency should behave. This is shameful... And at long last, someone with authority within the air board has finally figured this out... On Nov. 16, Dr. John G. Telles, a Fresno cardiologist appointed to the air board by Gov. Arnold Schwarzenegger in April 2008, wrote a letter to Ellen Peters, the air board’s chief counsel, in which he said the air board’s staff failed to meet its “ethical if not legal obligation” to provide all board members with pertinent information before a vote on a state regulation... Telles had never heard about Tran’s deception until a Sept. 24 air board meeting in Diamond Bar, when it was raised during public testimony about the harsh toll the diesel rules threatened to have on businesses whose trucks and off-road vehicles have to be scrapped or retrofitted at great cost... We could not agree more. Mary Nichols’ handling of this matter has been indefensible and outrageous... Will other air board members figure this out, too? Will the governor, whose office was informed about Tran’s deception last December?...

Ferro as Federal Motor Carrier Safety Administrator yesterday, putting a former trucking association executive in charge of the nation’s truck safety watchdog at the Department of Transportation... She takes charge at FMCSA as it reopens its rulemaking on truck driver hours of service, one of the most contentious issues facing the agency... Her nomination outraged the Teamsters union and several public safety groups opposed to changes in the hours-of-service rules that Ferro supported as head of the MMTA... At her hearing, she promised to be a “fair and balanced regulator” who would use “data-driven, sound scientific research” to significantly reduce truck and bus crashes... Erik Autor, vice president and international trade counsel for the National Retail Federation, said an executive order that bars lobbyists from serving on government advisory committees is a draconian measure that could harm public policy by isolating government officials from lobbyists who are experts in their fields... The president issued the order on Sept. 23 as a “commitment to the American people to reduce the influence of lobbyists in Washington out of a belief that lobbyists have too often in the past achieved disproportionate impact on government decision makers at the expense of broader voices from the public at large,” according to Norman L. Eisen, White House special counsel for ethics and government reform... Eisen noted that the ban would affect some lobbyists who represented groups that agreed with administration goals and objectives... It's uncertain how the ban will affect other advisory committees. Two members of the Customs and Border Protection Commercial Operations Advisory Committee, Earl Agron, vice president for security at APL Ltd., and Kenneth Roberts, director of international business relations for Kraft Foods, are registered in the Senate's Lobbying Disclosure Act database...

Program to allow carriers to look at accident history before hiring truck divers

Boyd -Oct 7, 2009: -- The agency that regulates trucking safety plans to offer carriers access to an electronic database of drivers’ inspection and accident records starting in December... Drivers would have to sign a consent form, said the Federal Motor Carrier Safety Administration, for the driver pre-employment screening program to allow trucking firms “to electronically access driver inspection and crash records as a part of the hiring process”... FMCSA said the program will also give drivers a chance to verify and correct the information that is in their records... Potential employers would get a look into the agency’s Motor Carrier Management Information System, which contains roadside inspection and compliance review results, enforcement data, state-reported crashes and motor carrier census data...

* Agency renews efforts to ensure safe transport - DOT Warns of Lithium Battery Hazards

Washington,DC<,USA -The Journal of Commerce, by R.G. Edmonson -Oct 7, 2009: -- The Department of Transportation is renewing efforts to ensure the safe transport of lithium batteries... The Pipeline and Hazardous Materials Safety Administration and Federal Aviation Administration issued a joint safety advisory on Wednesday to promote awareness of a hazard implicated in more than 40 incidents since 1991... On July 15, a shipment of several thousand loosely packed cell phone batteries was found smoking after it had been delivered to its destination. On August 14, a shipment of e-cigarettes, which contain lithium batteries, caught fire in an aircraft’s cargo hold... The regulations require packing for shipment that prevents breakage, short circuits or overheating... PHMSA said shippers that violate the regulations governing the transport of lithium batteries could face civil penalties up to $100,000 per violation, or a fine of $500,000 and 10 years in prison for a criminal conviction...


* Senator Sees Industry Support for Fuel Tax Hike

Washington,DC,USA -The Journal of Commerce, by John D. Boyd -Oct 7, 2009: -- Voinovich predicts big push by manufacturing, truckers for early transport bill... The top Republican on the Senate’s Transportation and Infrastructure subcommittee predicted that truckers, manufacturers and other key industry groups will push for a higher federal motor fuels tax to help get an early surface transportation law through Congress... Sen. George Voinovich, R-Ohio, told reporters that since the transport programs in the former multi-year highway law will expire after this month, “there’s an effort being made right now to try to figure out a compromise on the time for the extension”... Congress has not increased gasoline and diesel fuel taxes since 1993. Voinovich repeated his call to hike the fuel tax 10 cents a gallon, and then index it to inflation so that it keeps growing over the years without a new vote each time by Congress...

Holyhead,UK -HGV (Ireland) -7 June 2009: -- Another Irish haulage company has voiced it frustration at the intransigence of the Vehicle and Operator Services Agency (VOSA) in the UK and its unwillingness to listen to commonsense... The haulage company, which does not wish to be named in case of VOSA recriminations explained: "One of our trucks was stopped (November 2008) on route to Holyhead. According to VOSA he was overweight on the steering axle, whilst the drive axle and trailer axles were well within legal limits. That's a physical impossibility. We had to contract a tri-axle TU to pull the trailer to the port, which was 10 miles away... We gave load details to the manufacturer (MAN) who did a computerised analysis and confirmed our suspicion that is was impossible that the steering axle was overweight. "FALSE" TESTIMONY * USA - Sen. Boxer hints it from EPA chief

California approved a law in 2006 to enact new limits on emissions for cars and light trucks, but the Environmental Protection Agency decided not to grant the state a waiver that would have allowed them to enforce the new standard... Sen. Barbara Boxer, D-CA, criticized EPA Administrator Stephen Johnson’s denial in December 2007 and pointed out it was the first such denial in more than 50 waiver requests the EPA had granted to California... This week, Boxer – head of the Senate Committee on Environment and Public Works – released transcripts to the Justice Department for consideration in its preliminary investigation into whether Johnson provided “false, misleading or intentionally incomplete statements in his sworn testimony before the committee”... The letter asks Attorney General Michael Mukasey to look specifically at testimony provided to the EPW Committee on Sept. 23. On that day, EPA Principal Deputy Assistant Administrator Robert Meyers testified and provided responses that “appear to further support the conclusion that EPA Administrator Johnson provided false or misleading testimony to the EPW Committee,” Boxer wrote...

ARZ,USA -Land Line Magazine, by Charlie Morasch -June 2, 2008: -- Gerald Cook watched the Arizona DOT officer open his handbook to a dog-eared page toward the back. The words “television receiver” and an entire paragraph of text were highlighted... Minutes earlier on Sunday, May 25, Cook had pulled into Arizona’s Sam Simon Port of Entry scale house while traveling westbound on Interstate 10. The Arizona Department of Transportation officer questioned Cook about the laptop computer mounted in the front of his cab... Surely the officer wasn’t busting Cook for the computer that hundreds of inspection officers had seen before, mounted near his driver’s seat in his 2005 Peterbilt 379... The computer allows Cook to check e-mail messages from dispatchers and home and, more importantly, allows him to quickly and accurately enter hours-of-service data into his logbook software... After a few minutes, the officer told Cook he was being cited for violating a federal safety regulation that prohibits trucks from having “television” screens within the view of drivers... The officer told him the ticket could cost $450... Cook, who said his laptop was closed and in sleep mode, was stunned... Arizona officials are interpreting that laptop computers are covered by a Federal Motor Carrier Safety Regulation that was originally designed to prevent television viewing by commercial drivers, said Cydney De Modica, an Arizona DOT spokeswoman... Cook said the relatively new interpretation of an old regulation serves one purpose: “It’s a money grab,” Cook said... The five-year driver said he’ll challenge the interpretation of the federal law... “I’ll fight it until every cop car in the country doesn’t have a laptop in it,” Cook said. “My laptop is staying right where it is.”...

... “In most cases, agencies under Sunset review are automatically abolished unless legislation is enacted to continue them”...

TX,USA -Land Line Magazine -June 4, 2008: -- Members of a state oversight commission want to strip the Texas Department of Transportation of its power to set its own agenda... The Texas Legislature created the 12-member Sunset Advisory Commission in 1977 to review more than 150 government agencies on a 12-year cycle. The commission includes 10 state representatives and senators and two members from the general public. Their mission is to identify and eliminate waste and duplication... Following is a list of the Sunset Advisory Commission recommendations for TxDOT and the Legislature:

* Achieve greater accountability under the oversight of a single commissioner of transportation. Legislative action would include the abolishment of the Texas Transportation Commission and have it replaced with a single appointed commissioner.
* Establish a legislative oversight committee.
* Provide better access to independent transportation information and research.
* Increase transparency of TxDOT’s transportation planning and project development process.
* Improve TxDOT’s public involvement efforts.
* Make the department’s contracting functions more accountable, particularly its development of comprehensive development agreements.

CARB announced the changes Wednesday, May 28. The agency’s board approved the port rule in December, but CARB’s multi-tiered regulatory approval process includes several opportunities for changes before a final version is adopted... The revised port rule no longer requires truck operators to have an emission “compliance label” affixed to their truck, but requires all trucks to have 1994 or newer engines that meet or exceed 2007 model year engine emission standards by Dec. 31, 2009. Trucks must meet 2007 engine emission standards by Jan. 1, 2014... Also, CARB deleted its requirement that truck owners maintain a maintenance log for verified diesel emission control strategy retrofits...
