* California - Teamsters, LA trucker clash over alleged firings

Port of Los Angeles,CAL,USA -JOC, by Bill Mongelluzzo -Sep 05, 2014: -- A Teamsters-affiliated organization accused a Southern California drayage company of firing at least 33 drivers who filed wage and hour claims against the carrier, an accusation the company said is not truthful... Justice for Port Drivers, which is affiliated with the Teamsters, said Total Transportation Services Inc. fired the drivers on Thursday because they “refused to acquiesce to the company’s illegal demand to withdraw their claims for wage theft as misclassified ‘independent contractors” ... “Nobody was fired or terminated,” said Alex Cherin, executive director of the Harbor Trucking Association of Southern California. TTSI is an HTA member... In Southern California, as in other ports, most of the drivers are owner-operators, or independent contractors, which by law are extremely difficult to organize. The Teamsters’ strategy of late has been to support claims against individual companies, attempting to demonstrate that the motor carriers exert enough control over the drivers to constitute an employer-employee relationship...
