Workers complained of smoking in 2006, but charges disappeared
Toronto,Ontario,Canada -The Toronto Star, by Jennifer Yang -Oct 15 2009: -- Truckers were livid when an Ontario truck driver was fined for smoking on the job last week. But for Meyers Transport, the incident unearthed only unhappy memories... Last Wednesday, a 48-year-old truck driver from London was pulled over by the OPP on Highway 401 and given a $305 fine for allegedly smoking in his rig... Joe Ball, vice-president of drivers and safety with Meyers said, his company was also charged two years ago following an investigation of their Peterborough branch, although in their case the charges weren't issued by OPP but by a provincial health unit officer... Both charges have been laid under the Smoke-Free Ontario Act. The act, which has been in place since 2006, forbids smoking in the workplace, defined as anywhere inside a building, structure or vehicle... Meyers faced a maximum penalty of $10,000 and decided to fight the charges in court. The case went all the way to Superior Court but the charges were suddenly dropped on Jan. 14, 2009, the first day of the hearings... Ball said the company still permits smoking in trucks but make attempts not to "mix and match," meaning smokers and non-smokers are designated to different trucks. He concedes, however, that this is "not always possible"... Ball estimates about 60 to 70 per cent of Meyers' drivers smoke and, as an employer, he said it would be near impossible to enforce a no-smoking rule in the trucks...(Photo from i2.ytimg)
