* Bogota - Truck-driver strike in Colombia continues, riots reported

--- Several disturbances were reported due to road blockages in different parts of the country as the truck-driver strike in Colombia continued today... The strike, which has brought cargo transport to a halt for 25 days, has led to the Transportation Ministry announcing, first thing in the morning, that the Government had lifted restrictions on cargo vehicles moving during the holiday that will last until Monday... Transportation Minister Jorge Eduardo Rojas said that the measure would allow vehicle movement along the main roads in Colombia, without any difficulty, during the truck-driver-strike... Rojas recognized the most important areas that are still disputed are the economic conditions that set the value of freight and delimitation of some routes... Yesterday, trucks drivers clashed with the Police Mobile Riot Squad on the Duitama-Tunja road, in the sector of Higueras. Media outlets said the number of people wounded during the riot was still to be determined... Cargo Truck Drivers' union leader, Freddy Alvarado, clarified that the strike was continuing peacefully, but when they were about to stop a heavy truck that was passing, riot forces attacked the strikers...

INDEFINITE STRIKE * India: By tankers trucks owners

* Telangana - VAT on transportation brings trucks and tankers to a halt in 
--- As many as 3,000 trucks carrying petroleum products were off the roads on Monday following an indefinite strike in protest against the imposition of 14.5 percent Value Added Tax (VAT) on transportation charges... Telangana State Petroleum Tank Trucks Owners Association president, K Rajashekhar Reddy, rued that no state in the country has imposed such tax on petroleum goods transportation ... "All 3,000 tankers and trucks are participating in the indefinite strike until the tax is rolled back," Reddy said... Commercial Taxes department officials have held talks with oil marketing company officials in the last two days... On Sunday the officials held futile discussions with truck/tanker owners... Many petrol bunks here witnessed panic buying from consumers as they feared shortage of petrol and diesel following the strike...

STRIKE * Canada: Drivers haven’t had an increase in pay in a decade and are working longer hours

* Ontario - Container truckers strike for overdue pay raise


-- Participants in a week-old strike by hundreds of Ontario truckers who transport shipping containers hope their action will disrupt the industry enough to get a better deal for drivers... But some shippers warn the fallout, while minimal so far, could grow if the strike continues... The fledgling Container Trucking Association of Ontario says its drivers haven’t had an increase in pay in a decade and are working longer hours... The group isn’t unionized and wants truckers to be classified as skilled workers. It describes itself as a not-for-profit organization dedicated to representing the interests of independent truckers. Chopra said drivers’ operating costs keep rising and they wait longer than ever at rail yards, while their rates of payment haven’t changed in a decade... Some of their members have blocked CP and CN rail yards to delay shipments in and out. They’re also staging their trucks and holding picket lines...

The details of the deal between CTAO members and transport company CEOs were still unclear Wednesday afternoon. The group, which operates as a nonprofit, had asked transport companies recognize independent container truck drivers as “skilled workers,” a classification that would allow them to unionize — something not mentioned in any statements or posts made by the group...

TRUCKERS' STRIKE * India

* Kerala - Prices to go up if trucker strike continues


-- The ongoing strike by truck operators has not hit the markets in the State so far but if it continues it will lead to an increase in price of goods that are transported into the State from Tamil Nadu namely vegetables, rice, flowers, eggs, and chicken... The spiraling demand during Easter-Vishu season had led to a slight increase in price of these goods especially that of meat. There has been an increase of Rs 10 for one kg of dressed chicken which is at present selling at Rs 170 in the State... The traders say that markets have not being affected by the lorry strike though they fear that the situation will change if the strike continues. In wake of the strike, none of the traders have brought vegetable and other goods in bulk and stored them...

TRUCKERS STRIKE * India - AIMTC, announcing that no trucks would cross the inter-state border

* Tamil Nadu - Cargo traffic to Kerala to be hit as truckers plan strike

   --  While members of All India Motor Transport Council (AIMTC) are keen on preventing vehicles from entering Kerala from April 1, the president of Tamil Nadu Truck Owners' Association said he would not support the strike. Kerala commercial tax commissioner G Krishnakumar has called for a meeting in Trivandrum on March 31 with the lorry owners' associations hoping to resolve the issue. The AIMTC members stationed at Walayar said they have stuck posters at Walayar check post announcing that no trucks would cross the inter-state border to protest against the alleged highhandedness of check post personnel... K Nallathambi, president, Tamil Nadu State Lorry Owners' Federation said that based on decisions made in New Delhi, lorry owners will not function in Tamil Nadu... AIMTC members would hold a press conference at Walayar on March 31 announcing the indefinite strike... Their demands also include setting up of a scanning centre and a secured parking lot with basic amenities...

Los Angeles,CAL,USA -Orange County Register, by HANNAH MADANS -Nov. 18, 2014: -- Port truck drivers on Tuesday expanded their strike at the ports of Los Angeles and Long Beach to include two new companies. That brings to six the companies that are targets of the strike. The strike is exacerbating congestion at the ports, which is already high due to a lack of truck chassis and rising trade volume from the improving economy... Drivers from QTS Inc., LACA Express and WinWin Logistics Inc. went on strike Monday, and drivers from Pacer and Harbor Rail Transport struck on Tuesday... Port truck drivers want to be classified as employees and not independent contractors. As employees, they would be able to form a union and receive workplace protections...

* California - Port truck drivers threaten strikes again if retaliation persists

Los Angeles,CAL,USA -Patch Staff, by Mirna Alfonso -November 7, 2014: -- Port truck drivers urged the Harbor Commission Friday to take steps against companies they allege have been misclassifying them as independent contractors, stealing wages and firing dozens of workers in retaliation, while the Port of Los Angeles’ top official promised that solutions are on the way... Truck drivers told Harbor Commissioners they were ready to begin striking again, saying they have been retaliated against by their employers even after they stopped picketing this summer at the request of Mayor Eric Garcetti... Amilcar Cardona was fired by Green Fleet Systems, which had been employing him as an independent contractor. He returned to work today -- as an employee, this time -- thanks to a court injunction, but he said the mistreatment continues and demanded the mayor and harbor officials take action... “I wanted you to be aware that very soon we will go on strike,” he said. “I am asking, please do something, because the court has already decided I am an employee ” ... Representatives for the trucking companies were not immediately available for comment...

Violence again erupted at the port on Friday and the Ningbo government introduced a complete news blackout. Shipments through the busy international container port are facing severe delays and carriers are reportedly diverting vessel calls to Shanghai while shippers truck containers from Ningbo... The drayage drivers, dissatisfied with haulage rates they could earn at the port, launched a protest earlier in the week, bringing the port to a standstill. The labor action comes in the midst of peak season, when ships headed to the U.S. are full and reports were proliferating of cargo booked at lower freight rates being left behind, or rolled, to subsequent sailings... According to a report from the National Employment Law Project, the Los Angeles Alliance for a New Economy, and the Change to Win Strategic Organizing Center: ... Imagine your boss suddenly told you that from now on you were going to be considered an independent contractor. You’d have to pay for your office space, supplies, and equipment. Your employer would deduct those expenses from your paycheck. And you’d have to pay all your payroll taxes, including your employer’s share. You’d also be responsible for doing whatever work your boss gave you, no matter how long it took, with no extra pay... That’s the situation most of the nation’s port truck drivers are in.... The companies that hire two-thirds of port drivers deduct the cost of buying and maintaining their trucks from their paychecks. The drivers have to pay for fuel and take care of all the payroll taxes. They get no benefits, no workers’ compensation coverage or unemployment insurance, and they earn much less money than their officially employed counterparts... Instead, the drivers get a fixed amount of money, no matter how long it takes to pick up goods at the port and deliver them to warehouse distribution centers. Even though the drivers are only allowed to work for one company, that one company illegally treats them as independent contractors instead of employees... In early July, 120 port drivers in Southern California went on a five-day strike... The strike, backed by the Teamsters union, is part of a new national effort to force employers to comply with the law. Drivers have filed more than 400 claims against companies under California’s wage and hour laws. The first 19 rulings resulted in an average award of $66,240, largely for wage and hour violations and illegal paycheck deductions for items like truck leases...

Vancouver,BC,Canada -JOC.com, by Bill Mongelluzzo -Jul 22, 2014: -- The union representing about 400 harbor truck drivers at Port Metro Vancouver has given Canadian officials until July 30 to enforce government-mandated pay rates for drivers, or face another possible trucker strike at Canada’s largest port... McGarrigle met Monday to discuss what he termed trucking companies’ widespread violation of the new trucking rates announced in March by federal mediator Vince Ready. Representatives of the more than 1,000 non-unionized drivers in Vancouver were also at the meeting... The rates negotiated by Ready increased driver wages by 12 percent and doubled the fuel surcharge, which trucking companies must pass along to the drivers. It was negotiation of those rate increases that convinced both unionized and non-unionized drivers to call off a month-long strike that had crippled the Pacific Coast port... However, more than three months later, many harbor trucking companies are still not adhering to the rate increases, McGarrigle said...

The picket lines are the largest demonstration yet against several regional truck companies that haul freight from the nation's largest port complex. Drivers argue they are improperly classified as independent contractors, leaving them with fewer workplace protections and lower pay than if they were company employees, protest organizers said...

* Vancouver - Port to pay for wait time

Vancouver,BC,CAN -By Go By Truck News -May 26, 2014: -- Nearly two months after container truckers on strike at Port Metro Vancouver returned to work, mediator Vincent Ready has released his recommendations for wait time payments... To that end, Ready provided a formula for wait time payments along with several requirements for the port terminals and trucking companies. Starting May 28, all per trip drivers will be paid for wait time exceeding 90 minutes. The first payment, at 90 minutes, is $50. After that, drivers get paid every 30 minutes. At two hours and two-and-a-half hours, drivers receive $25. For every thirty-minute period exceeding two-and-a-half hours, the drivers receive $20. Ready stipulated that while terminals will send the payments to trucking companies, the companies will be required to pass them on to the effected drivers...

Ready was appointed to mediate the situation by the federal and B.C. provincial governments as part of their Joint Action Plan (JAP)... In releasing his recommendations, Ready acknowledged just how complicated the situation is at the port, and how difficult it will be to implement fixes... Ready provided a formula for paying drivers for wait times, and established that the fee must be forwarded to drivers, and not retained by the trucking companies...

They are demanding that they be reclassified as hourly wage workers, instead of being considered as so-called independent contractors... They blocked trucks and other traffic for up to five minutes or more at a time before letting a few trucks pass from each of three directions... Workers from the three companies also set up picket lines at entrances to the Port of Long Beach and the Port of Los Angeles. Members of the International Longshore and Warehouse Union stayed off the job in solidarity for four hours on April 28 at the Long Beach port, before returning to work under an arbitrator’s order...

Los Angeles,CAL,USA -AP/CBSLA -28 April 2014: -- Truck drivers who haul cargo in and out of the twin Ports of Los Angeles and Long Beach planned to go on a two-day strike beginning Monday that they said was directed not at the busy ports themselves but at the companies that employ drivers... The truckers have previously picketed at the trucking firms, and the group Justice For Port Truckers said it will take the rally to the ports’ cargo terminals Monday... The truckers contend many of the companies wrongly classify drivers as independent contractors rather than employees in order to pay them less and deny them protections that employees get under state and federal laws... Industry experts estimate that only 10 percent of truckers are employed by companies, and in recent years, truckers who are classified as independent contractors have filed lawsuits and complaints with state and federal labor agencies to change their status...

Savannah,GA,USA -The Savannah Morning News, by Mary Carr Mayle -29 April 2014: -- Dozens of short-haul truck drivers staged a protest Monday morning outside the gates of Garden City Terminal, contending they are being treated unfairly by the trucking companies who hire them to move containers in and out of the port... A study released earlier this year by the National Employment Law Project and other organized labor think tanks concluded that 75,000 truckers at ports across the country are in the same situation and each of them loses more than $5,000 monthly in compensation they would have gotten as employees. The groups say that totals $1.4 billion annually on a national basis... In Georgia, the labor-sponsored study estimates nearly 4,000 of the 6,000 port drivers are misclassified...

The truck drivers, from some of the region's largest trucking companies, have accused the companies of illegally misclassifying them as independent contractors instead of as employees. That misclassification results in lower wages and denies them protections that employees get under state and federal labor laws, they contend... Tensions between drivers and the drayage companies have escalated in recent years. Industry experts estimate that only 10% of truckers are directly employed by companies, and truckers who are classified as independent contractors have filed lawsuits and complaints with state and federal labor agencies to change their status... In California, port drivers have filed more than 500 complaints for wage theft related to misclassification, according to the state Department of Industrial Relations...
