* Texas - Bills with eye on trucking rules now law and others

The new law, prohibits motor carriers from operating intrastate if the FMCSA has prohibited them from operating in interstate commerce because of safety concerns... The bill also prohibits an employer from knowingly permitting a person to drive such a vehicle if the employer is subject to an out-of-service order affecting a driver or vehicle... Another law, it brings state law in line with federal rules for saddlemounts. The rule changes the maximum length for saddlemount vehicle transporter combinations in the state from 75 feet to 97 feet... Two more bills deal with cargo securement... One would add refuse and aggregates to the list of material that must be covered to prevent from blowing or spilling from trucks. Senate and House lawmakers have approved the bill... Another bill would have allowed haulers to be penalized for failure to properly secure cargo before an incident occurs... Still another bill that has been sent to Perry’s desk relates to cattle guards on county roads. Texas law now only permits counties with populations of less than 60,000 to construction of cattle guards on county roads. The bill would remove the population limit...
* Nevada - Stricter seat-belt rule canned in
NV,USA -Land Line Magazine (Grain Valley,MO) -June 11, 2007: -- Drivers in Nevada who don’t like to wear seat belts can continue to travel through the state without fear of being pulled over for not buckling up... A bill that would have allowed for primary enforcement of the state’s seat belt law missed a deadline to advance from committee in the Assembly, effectively killing it for the year. The Senate previously approved the bill – SB42 – on an 11-10 vote... Nevada is one of 24 states without a primary seat-belt law. Maine’s recent adoption of the stricter rule brings to 25 the number of states that allow police to pull over drivers solely for not wearing their seat belts. New Hampshire is the only state without a mandatory seat-belt law...
* Failed Alabama bills addressed fuel taxes, left-lane use and probable cause
AL,USA -Land Line Magazine (Grain Valley,MO), by Keith Goble -June 11, 2007: -- One bill that ran into a roadblock sought to allow county commissions to increase the excise tax on motor fuels by resolution. State law now requires the Alabama Legislature to sign off on local efforts to levy county excise taxes... A separate bill was intended to combat aggressive driving on multi-lane highways by keeping the far left lane clear of most traffic. It failed to meet a deadline to advance from the House floor to the Senate... One other bill would have given law enforcement officers more power during roadside stops... Under existing state law, an officer is not generally authorized to arrest a person for a misdemeanor traffic offense that is not committed in the presence of the officer...
* Colorado governor approves stiffer fines for chain law violations
CO,USA -Land Line Magazine (Grain Valley,MO), by Keith Goble -June 11, 2007: -- Despite the fact that summer is approaching, Colorado Gov. Bill Ritter has signed a bill into law intended to make a difference when winter precipitation starts to wreak havoc in the state... The new law, increases the base fine to $500. The fine doubles to $1,000 if trucks not in compliance block traffic. The higher fines go into effect in August... While the bill was working its way through the statehouse, lawmakers and truckers shared their concern that there is a lack of adequate space on roadways for drivers to install chains. In addition, too few designated chain-up sites along routes was cited as a problem for truckers... To help alleviate some of the problem, the Colorado Transportation Commission officials said they plan to build six new chain-up stations... “It should be the company’s responsibility if they’re running in snow country to have them,” he said...
