Criminal Negligence - Canada - Trucking company operator found guilty
Sudbury,ON,Canada -NorthernLife.ca, by KEITH LACEY -June 2, 2006: -- The operator of a local trucking company has been found guilty of criminal negligence for allowing a driver to operate a vehicle that got involved in a collision with a moving train knowing the brakes on the tractor-trailer were grossly defective... The tractor-trailer crashed into a moving CPR train at about 45 miles an hour on April 26, 2003 at the Windy Lake railroad crossing, causing the train to derail, resulting in more than $2.5 million in damages... The vehicle was described by one inspector as being in the worst condition of any vehicle he inspected in 15 years on the job. Several other inspectors reported only one set of the 18 brakes was in decent working order at the time of the accident... Milos Peric, 47, was found guilty by Justice Robert Del Frate, who rendered his decision after a trial that lasted several months and took up 49 days of court time.The vehicle was not insured as Peric was experiencing financial difficulties at the time. The name of the company operated by Peric at the time was called City Capital...
