Long Beach,CAL,USA - The Journal of Commerce, by Bill Mongelluzzo -8 Jan 2009: -- Members of California’s congressional delegation asked the Federal Maritime Commission to drop its challenge to the Los Angeles-Long Beach clean-trucks program, especially the concession requirement that calls for replacing owner-operator truck drivers with employee drivers... In separate but related litigation, the U.S. Court of Appeals for the 9th Circuit in San Francisco is expected to set a date for oral arguments in a suit filed by the American Trucking Associations... The Los Angeles court last fall turned down the ATA’s request for a preliminary injunction against the clean-trucks concession requirements. ATA challenged the employee-driver mandate as a violation of the federal pre-emption statute covering interstate trucking... Since then, the Department of Justice, filing on behalf of several federal agencies, asked the 9th Circuit for permission to present oral arguments in the case. The federal agencies argue that the U.S. government has pre-emptive authority in matters involving national security and the regulation of motor carrier safety...
