Lorry drivers flouting rest break laws were targeted in a two-day operation

Talybont,Bangor,Wales,UK -The Daily Post, by Steve Bagnall -Dec 22, 2007: -- Operation Carrier saw 35 HGVs stopped by officers during Tuesday and Wednesday evenings this week on the A55 near Talybont, Bangor... Four drivers were served with 24-hour prohibitions for failing to take weekly rest and/or failing to produce tachograph charts... Fifteen drivers were served with nine-hour prohibitions for failing to take a daily rest... One lorry driver was ordered to take a 45-minute rest break prohibition. Eight cautions were issued for minor infringements... The focus of the operation was checking the mechanical condition of lorries and also to ensure the drivers had taken sufficient rest periods... Inspector Pete Nicholson added: “It is always a concern when we find drivers who have not taken appropriate rest breaks... “They are not only putting themselves at risk, but also other road users”...

The stock closed at $9.13 on Dec. 19, down from nearly $17 in late August. The stock is down nearly two-thirds from its peak of $22.41 in July 2006, before the industry slump. Celadon isn’t alone: Yellow Freight parent YRC Worldwide, for example, has also been hammered on Wall Street. YRC now trades around $17.50, a steep decline from its 52-week high of $47...“At these very low valuations for the company, at what point do you entertain the thought of taking the company private?” Oppenheimer & Co. analyst Bruce Olipha asked Celadon’s chairman, Steve Russell, during a recent earnings call. “It’s difficult to answer that question,” replied Russell, mindful that four years ago the stock had tanked below $4 and later grew sixfold. “Let’s see what happens in the months ahead.” Celadon founder Russell, for now, is seeing what his new president—former General Electric trailer leasing executive Chris Hines—can do to put more stuff aboard Celadon’s trucks. Tata launched seven medium and heavy trucks in Pune on Thursday. The company will launch four more in the financial year 2008. The new vehicles include a 49-tonne tractor trailer, a 49-tonne Novus tractor and a 31-tonne truck with lift-axle. All vehicles comply with the BS II emission norms. The train trestle is part of the $60 million Great River Bridge project which includes construction of a second bridge, rebuilding the existing span and raising the trestle. But miles of railroad track on both sides of the bridge first have to be rebuilt... The typical work day is eight hours, but for most truck drivers it is longer. Drivers can have their big rigs on the road for 11 hours straight before they're required by law to stop for the day.

Last year, the Bush Administration changed truckers allotted driving hours from 10 to 11... Now, many members of Congress want to change it back. They claim 11 hours is too long, and pushes drivers to their limit... Four-thousand trucks travel through the Treasure Valley every day, many of them from out-of-state that are anxiously trying to drop off their loads so they can get back home... There are incentives to make miles quickly, but some lawmakers say that's dangerous... The truck drivers we talked to say they are responsible at the wheel and know their limits... (SEE VIDEO)


* Sleeping Truck Drivers Cause Accidents
USA -Johnny Brunson.com -December 21st, 2007: -- Last week the Center for Disease Control (CDC) celebrated Drowsy Driver Prevention Week. Interestingly, in a poll conducted as part of their education campaign, 47 percent of commercial truck drivers admitted to having fallen asleep while driving a truck during some point in their career... In a study conducted of the sleep patterns of long haul truck drivers and printed in the New England Journal of Medicine, drivers obtained between 4 and 5 hours of verifiable sleep during the course of driving ten-hour days in a five-day period. Most people need between 7 and 9 hours of sleep per night. Thus, fatigue and sleep deprivation constitute significant safety issues for long haul truck drivers... Truck driver fatigue is the subject of new U.S. Department of Transportation (DOT) regulations. Tractor-trailer truck drivers may only drive for eleven hours after ten hours off. The National Transportation Safety Board states that driver fatigue may account for one third of all large (semi, tractor-trailer) truck accidents. Further, driver fatigue was the likely cause in thirty percent of all fatal crashes... Accidents involving sleeping drivers – and worse sleeping truck drivers – often yield tragic consequences. Sleeping drivers usually maintain their speed; thus, not braking or turning to avoid the accident.

FUEL COSTS * USA - Increase in Diesel Prices Affect Truck Drivers

Huntington,WV,USA -WSAZ/TV, by Michael Wooten -Dec 21, 2007: -- In some places gas prices are down 50 to 75 cents a gallon from the all-time high, giving people a few extra dollars in their pockets for Christmas. That’s for those who use gas and not diesel to fill their tanks... However, pumped up prices is the rough reality for truckers as diesel prices hit record highs... Until a few years ago, that was true, but not any more. Thanks to higher demand, a transition to low-sulfur fuel and slightly higher taxes, diesel now costs more... Prices are even higher in the winter due to rising demand for heating oil, which is refined in much the same way as diesel... Diesel prices vary widely in our region. Kentucky's average is $3.30 a gallon. In Ohio it costs 15 cents more on the gallon and in West Virginia prepare to pay $3.52 a gallon. Only about a dozen states have higher averages... David Grier, a truck driver, doesn't see any relief in his rear-view mirror... This affects more than just truck drivers... Millions of cars, lights trucks and SUV’s also use diesel, and those drivers are hit especially hard... The forecast isn't promising for diesel drivers. New York,NY,USA -The New York Times, by AL BAKER -December 22, 2007: -- It began as a brazen robbery and kidnapping in Hells Kitchen on the West Side, as men with guns and a phony police badge hijacked a FedEx tractor-trailer loaded with holiday gifts... It ended hours later in Brooklyn as just another bungled crime when the would-be robbers were unable to figure out how to remove the metal cargo containers, filled with merchandise, locked up in the back of the truck, the police said Friday... The episode unraveled little by little over seven hours, the police said. In the end, the truck driver was unharmed and none of the cargo appeared to be missing, officials said — not even the jewelry and other valuables...

RECALLS * USA - GM recalls 313,000 for fluid leak

Washington,DC,USA -Associated Press/The Detroit News, by Ken Thomas -December 22, 2007: -- General Motors Corp. said Friday it was recalling about 313,000 passenger cars and crossover vehicles to fix a fluid leak that could lead to the driver losing control of the vehicle... GM said the seal on the rear axle pinion, which provides power to the wheels, does not meet all specifications and could leak fluid. GM spokeswoman Carolyn Markey said the leak could lead to the drivewheel jamming up and locking while the vehicle is being driven, possibly causing the driver to lose control...

A company with roots in Australia will control 90 percent of the design, finance, construction and operation of high-occupancy toll lanes on the Capital Beltway in Washington, DC, and Virginia

Transurban, an Australian firm that finances and operates the Pocahontas Parkway in Richmond, VA, and Texas-based Fluor Enterprises have landed a contract to expand 14 miles of the Beltway from eight lanes to 12 lanes. The expansion will be between the Springfield Interchange and Tyson’s Corners... U.S. Department of Transportation officials said once construction is finished, the two existing middle lanes will be converted to HOT lanes with fluctuating tolls based on traffic volume... Car poolers, buses and emergency vehicles will not pay tolls to use the HOT lanes. However, individual drivers, including truckers, will be able to pay tolls to get out of the regular lanes and use the less-congested HOT lanes... The Capital Beltway is owned by the Virginia Department of Transportation, but Transurban will operate the HOT lanes for 75 years and use toll revenue to pay off the loan and bonds...

Safety advocates went to federal court Thursday asking judges to block a Transportation Department rule on work hours for truckers

Washington,DC,USA -CNN, by Paul Courson -20 Dec 2007: -- The controversy dates to 2003, when the Bush administration increased from 10 to 11 hours the limit a commercial trucker may drive without a mandatory break within a 14 hour period... Opponents, citing the risk of driver fatigue, twice persuaded a federal court to reject implementation of the extended hours... Despite those setbacks, the Transportation Department's Federal Motor Carrier Safety Administration has put into place an "interim final rule" that places a daily limit at 11 hours a day and up to 70 hours a week depending on whether the trips are long-haul or local... Sen. Frank Lautenberg, D-New Jersey, a member of a committee reviewing trucker safety, issued a statement after a hearing Wednesday saying the rule "allows truckers to drive for 30 percent longer each week, putting families at higher risk of an accident involving a tired truck driver"... * Mack Trucks' deliveries drop 49 percent

Mack Trucks' deliveries continued their slump in November, dropping 49 percent from the same month in 2006, its parent company Volvo AB reported Thursday... But the market forces behind the weak truck demand have changed since earlier this year, when new emissions standards caused truck deliveries to plummet. Slow housing construction and freight demand are now to blame for the weak demand, which Mack expects to continue into 2008... Mack delivered 1,539 trucks in November, down from 3,016 in the same month last year. Mack deliveries are a direct representation of demand for its trucks. The company does not manufacture trucks on speculation, but responds to orders from dealers...

One federal agency is telling another federal agency that electronic on-board recorders are needed on all heavy trucks and not just the trucks of companies that have bad safety records

Washington,DC,USA -Land Line Magazine -December 20, 2007: -- The Federal Motor Carrier Safety Administration has proposed on-board recorders for the “bad actors” in the industry... According to the proposed regulation, if FMCSA officials determine – based on HOS records reviewed during each of two compliance reviews conducted within a two-year period – that a motor carrier had a 10 percent or greater violation rate, the carrier would be mandated to use EOBRs for two years... All of the trucks owned and leased to the motor carrier would be required to have EOBRs installed, according to the proposed reg... But the head of the National Transportation Safety Board is calling for recorders on all trucks... In a recommendation published Monday, Dec. 17, NTSB officials cited a fatality accident from July 2004 in Michigan as a case in point... Investigators found that a truck driver for Equity Transportation Company had been driving for 14 hours straight when a crash occurred. Congested traffic had queued up on Interstate 94 near Chelsea, MI, and a witness testified that the truck was traveling at 60 mph...

Since 2005, California has sought an EPA waiver to begin requiring the nation’s first greenhouse gas emission standards for new vehicles sold in California. The law has been approved by 16 other states, and is one of several ways California is trying to reduce emissions to 1990 levels by the year 2020... EPA Administrator Stephen Johnson cited President Bush’s approval of a 35 mpg federal fuel economy standard on Wednesday, Dec. 19, in explaining his agency’s rejection of the California request... “The Bush administration is moving forward with a clear national solution – not a confusing patchwork of state rules – to reduce America’s climate footprint from vehicles,” Johnson said. President Bush and Congress have set the bar high, and, when fully implemented, our federal fuel standard will achieve significant benefits by applying to all 50 states”... * Emissions decision draws fire - Calif., other states vow to sue EPA for blocking enactment of stricter rules
Washington,DC,USA -The Detroit News (Detroit,Mich), by David Shepardson -December 21, 2007: -- Critics mounted a fierce attack on the Environmental Protection Agency's decision to deny California and other states the right to impose strict vehicle tailpipe emissions limits, with House and Senate committees demanding documents and many state governors vowing to sue to overturn the decision... President Bush defended the federal agency's decision on Thursday. "Is it more effective to let each state make a decision as to how to proceed in curbing greenhouse gases? Or is it more effective to have a national strategy?" Bush said in a year-end press conference. "(EPA) Director (Stephen) Johnson made a decision based upon the fact that we passed a piece of legislation that enables us to have a national strategy"... On Wednesday, Johnson denied California's request to require a 30 percent cut in vehicle tailpipe emissions by 2016, which would have set fuel efficiency requirements of 43.7 miles per gallon for passenger cars and 26.6 mpg for most light trucks... The decision came the same day Bush signed an energy bill that will raise fuel economy standards 40 percent to an industry fleet average of 35 mpg by 2020... California and other states that were seeking the waiver to impose standards stricter than the federal mandates vowed to sue the EPA. Their protests were supported by Rep. Henry Waxman, D-Calif., chairman of the House Government Oversight Committee, who sent a two-page letter to EPA administrator Johnson demanding "all communications within the agency and all communications between the agency and persons outside the agency, including persons in the White House, related to the California waiver request"... California Gov. Arnold Schwarzenegger said Thursday the state will sue to overturn the decision within three weeks in the U.S. Court of Appeals in Washington. At least eight other states plan to join the lawsuit... "(The) EPA's denial of our waiver request to enact the nation's cleanest standards for vehicle emissions is legally indefensible," Schwarzenegger said. "Anything less than aggressive action is inexcusable"... Connecticut Gov. M. Jodi Rell called the decision laughable. "They have gone from being a passive failure to actively interfering with progress. It is beyond inexplicable: It is inexcusable"... Rep. We learned that the Mexican government has recently been undertaking an exercise to estimate the impact of retaliating against the U.S. if this pilot program is halted,” Janet Kavinoky, a U.S. Chamber of Commerce lobbyist who focuses on transportation legislation, told Copley News Service... “Mexico will retaliate by not allowing exports of U.S. pork, rice and possibly other products – because we’re violating NAFTA”... The U.S. Chamber of Commerce has been a big proponent of the cross-border program... Heavy trucks do not currently have a mileage standard, but the energy act directs the National Academy of Sciences to study and develop fuel mileage standards for heavy trucks. The government could require efficiency improvements once a benchmark is determined... Truck manufacturers have been resisting the implementation of mileage standards... Officials with the Truck Manufacturers Association have said mileage varies greatly depending on the specific application of each truck. TMA President Robert M. Clarke said Wednesday a study should help bring clarity and educate regulators and manufacturers about what is realistic and what is not with a new standard... Truck manufacturers want at least four years of lead time before a regulation is finalized, Clarke said, and an additional three years for implementation... Meanwhile, the mileage for passenger vehicles will be increased from 27.5 miles per gallon to 35 mpg for cars and from 22.5 mpg to 35 mpg for light trucks and SUVs. The increase is scheduled to occur in increments from model year 2011 through 2020...

The Federal Motor Carrier Safety Administration (FMCSA) issued an interim final rule last week. The rule, which was twice thrown out by the court, allows truck drivers to work as many as 84 hours a week. The rule is almost identical to the industry's 2003 proposal, Byrd said... Byrd said the FMCSA cherry-picked from studies supporting its position that an 11-hour driving limit did not result in more fatal crashes than the previous limit of 10 hours... The Teamsters reviewed the information provided by FMCSA and found that it does not support the agency's claim... Byrd said FMCSA acknowledged in the past that the risk of a crash doubles from the 8th hour to the 9th hour of driving, and doubles again from the 10th to the 11th hour... The Federal Motor Carrier Safety Administration (FMCSA) first promulgated the hours-of-service rule increasing the number of hours truckers can drive in 2003. The Court of Appeals for the D.C. Circuit struck down the rule in 2004, but Congress reinstated it as part of the Surface Transportation Extension Act of 2004... FMCSA issued a new Notice of Proposed Rulemaking in January 2005, proposing a rule that was little changed from the 2003 rule that had been struck down... On July 24, the U.S. District Court of Appeals for the D.C. Circuit for the second time threw out the rule that increased driving time to 11 hours from 10 hours and allowed drivers to go back to work after being off duty for only 34 hours... In the 39-page opinion, Judge Merrick Garland called the rule "arbitrary and capricious"... The International Brotherhood of Teamsters was a party in the case, joining Public Citizen and the Owner-Operator Independent Driver's Association... The deadline for the court's July decision to go into effect was Sept. 14. But legal challenges pushed that deadline back. FMCSA issued the interim final rule on Dec. 11...

The Federal Motor Carrier Safety Administration last week issued an interim final rule that maintains the current 11-hour driving limit, under which truckers are required to rest for 10 hours. The public has 60 days to comment on the interim final rule... The U.S. Court of Appeals for the District of Columbia Circuit in September delayed until Dec. 27 a requirement that would reduce the continuous driving limit to 10 hours with eight hours of rest. The court issued a similar order two years ago... Consumer advocates sued to reduce the amount of time truckers can stay behind the wheel continuously, arguing that longer hours put everyone on the road at risk... Joan Claybrook, president of Public Citizen, told the Senate subcommittee on surface transportation and merchant marine infrastructure, safety and security, that it is "insanity" the government twice ignored court orders... The Mass Pike is the only highway that has a special regulation requiring drivers to clear debris, but police say it is almost impossible to enforce... Canada -Truck News -14 Dec 2007: -- As the cold weather approaches, fleets and owner/operators will begin to winterize their vehicles, especially against air system freeze-ups. Here are some basic tips for optimum cold weather operation from brake system experts.

* Engine Idle: Avoid idling the engine for extended periods of time.
* Discharge Lines: The discharge line should slope downward from the compressor discharge port without forming water traps, kinks, or restrictions.
* System Leakage: Check the air brake system for excessive leakage using your brake system's troubleshooting guide.
* Reservoir Draining (System without an air dryer): Routine reservoir draining is the most basic step (although not completely effective) in reducing the possibility of freeze-up.
* Alcohol Evaporator or Injector Systems: Using an alcohol evaporator or injector in conjunction with an air dryer is not recommended.
* Air Dryers: Proper air dryer operation is critical to helping your system run clean and dry.
* Thawing Frozen Air Lines: Here are some simple Do's and Don'ts for prevention and thawing:

Do
- Check the air dryer for proper operation, changing the desiccant cartridge and purge valve as necessary.
- Thaw out frozen air lines and valves by placing the vehicle in a warmed building. This is the only method for thawing that will not cause damage to the air system or its components.
- Use dummy hose couplings on the tractor and trailer.
- Check for drooping air lines, which could form water traps.
Don't
- Do not apply an open flame to air lines or valves. This practice is unsafe and can result in a vehicle fire. It can also damage the valve and melt the air lines.
- Do not pour fluids into air lines or glad hands. Certain fluids can cause immediate and severe damage to rubber components. Even methanol, which is used in alcohol evaporators and injectors, should not be poured into air lines. Fluids poured into the system wash lubricants out of valves, collect in brake chambers and valves, and can cause malfunction. Loss of lubricant can affect valve operating characteristics, accelerate wear and cause premature replacement.
- Do not immediately park a vehicle outside after thawing its air system indoors. Condensation will form in the system and re-freeze. Place the vehicle in operation when it is removed to the outdoors.

Speaking to New-York based transportation market analysts at Bear Stearns, the supplier said he was forecasting Class 8 builds of only 200,000 in 2008, based on the level of demand he was seeing from customers for his parts. Those estimates, he added, are very “back-end loaded” suggesting that there is upside to his if the economy should strengthen throughout the year... While there's been an encouraging jump in truck demand this fall, industry sources still predict a prolonged downturn... Furthermore, Bear Stearns explains, the source believes many truck manufacturers are just now facing the reality that demand will not pick up until mid-2008. Many of his customers, he continues, expected to see a significant ramp up in demand in late 2007, which has not materialized... While there was an "encouraging" spike in orders this past October, compared to previous months, the supplier cautioned that the boost was mainly a result of large orders from one or two fleets and may not represent a true upturn in overall industry demand.

This is becoming a global problem. Economists will tell you that labour shortages are not supposed to happen. When something is in short supply, excess demand pushes the price up. This reduces demand and increases supply. When it comes to skilled labour, the supply response is by necessity gradual, and may be very difficult, since it requires education and, perhaps re-education of transitioning workers... The solution? Grow the company without labour force growth. That means increasing automation in domestic plants, relying on only the most skilled workers, and expanding the business in other countries. A global production structure, facilitated by international trade, is the quickest route to higher productivity growth, as experience in the U.S. illustrates. Thats why global cross-border investment has been growing by some 30% per year in the last 3-4 years, and why a country like the Czech Republic can see inbound investment growing by 42% per year...

Small wonder: Because there are price controls on diesel fuel, the country's state-run oil refiners lose money on every gallon of diesel they sell. Those price controls also give refiners reasons to use the cheapest, dirtiest, most sulphurous crude they can get away with. Most of the 10 million trucks on China's roads burn diesel that has 130 times the amount of sulphur sold in diesel fuel in the U.S.... The result is a ban on daytime trucking in some cities. By morning, however, the diesel soot blocks out the sun. It's not only an aesthetic problem. Diesel soot gets embedded deep in people's lungs, where cancer can develop... Ironically, as China's booming economy expands, and roads are improved, transport time could be reduced. Except that diesel fuel is rationed, so that a truck driver might get as much as a quarter tank of diesel, or as little as five gallons. For that, he has to wait in line - his truck idling all the while - for up to 10 hours. The office says the audit's objectives will be to determine whether:

* Sufficient mechanisms exist to determine whether the project is hurting motor-carrier safety.
* Sufficient federal and state monitoring and enforcement exist to make sure participants are obeying all laws and regulations.
* The project involves a representative and adequate sample of Mexican carriers likely to haul deep within the United States.

The rule is in response to a July U.S. Court of Appeals decision vacating key aspects of the 2005 hours rule, effective Dec. 27. In order to ensure no gap in rule coverage, the IFR temporarily reinstates those two provisions while the agency gathers public comment on its actions and its underlying safety analysis before issuing a final rule... Truckers will continue to be limited to driving 11 hours within a 14-hour duty period, after which they must go off duty for at least 10 hours. The IFR also preserves the ability to restart cumulative limits by resting for 34 hours... The agency stated it developed the rule after new data showed that safety levels have been maintained since the 11-hour driving limit first was implemented in 2003... Teamsters General President Jim Hoffa said he does not believe evidence exists that the new rule is safer... Adrian Lund, president of the Insurance Institute for Highway Safety, said the agency “still believes the way to address the problem of fatigued drivers behind the wheels of big truck rigs is to allow them to drive even more hours than past rules allowed”... The ATA, on the other hand, applauded the IFR. The existing regulations “have led to a reduction in deaths and injuries over the last several years,” said Bill Graves, association president and chief executive officer... By 2013, the state would allow only post-2004 trucks to operate without "highest-level" emissions controls... "I have more than $1 million in older equipment here," said Ron Faulkner, owner and operator of Tulare-based Faulkner Trucking. "That would pretty much wipe that out. It can't be sold. Who would buy it?"... Faulkner, who has 27 trucks, said he would be stuck with the expense of replacing trucks and gear that are aging but reliable... First-year results of the study have shown that biodiesel performs similarly to diesel fuel in trucks

Washington,DC,USA -Agriculture Online -14 Dec 2007: -- A new study underway examines the benefits of a 20% biodiesel blend (B20) in an over-the-road trucking company... Logging the miles: The study consists of two groups of 10 Decker Truck Line Inc. semi tractors running with flatbed trailers on matched routes to either Minneapolis or Chicago. The control group uses 100% No. 2 petroleum diesel. The B20 test group uses a blend of 20% biodiesel from Renewable Energy Group, Inc. and 80% No. 2 petroleum diesel. Data is routinely analyzed for fuel efficiency, maintenance records and fuel quality... More than 1.5 million miles had been logged by the end of the first year leading up to October 1, 2007. Overall fuel efficiency, including idle time, was slightly reduced in the B20 group. Average fuel consumption for the control group was 6.29 miles per gallon (mpg) and for the B20 group it was 6.15 mpg. The fuel efficiency difference of 2.2% between groups is not considered significant, especially when compared to driver variability... Driver fuel efficiency ranged from 5.72 mpg to 7.40 mpg for the control group, a 23% spread. For the B20 group, fuel efficiency ranged from 5.76 mpg to 7.00 mpg, an 18% spread among drivers... Winter driving resulted in relatively few problems regarding cold-flow issues. Fuel for both groups was treated with a commercial fuel additive, and No. 1 diesel, a 40% blend, was used for a brief time during a severe cold snap in February 2007. No drivers experienced fuel gelling problems... Says Don Heck, coordinator of biotechnology and biofuels programs at Iowa Central Community College in Fort Dodge, Iowa, "Right now, the B20 performs similarly to the 100% diesel fuel in this study"... At the conclusion of the study, engines from both the control group and B20 group will be torn down for a closer analysis of engine wear...

I am referring to current congressional thinking on national energy policy, which is based on the Myth of Endless Growth and the Doctrine of Uninterrupted Joy... The Doctrine of Uninterrupted Joy says we have a right to whatever resources are available wherever they are available at affordable prices -- best defined as prices lower than those paid by anyone else... That thinking is reflected in the latest House energy bill, which would require automobile manufacturers to increase their new-fleet corporate average fuel economy (CAFE) to 35 miles per gallon by 2020 -- a 40 percent increase over current CAFE standards... It is feel-good legislation. Democrats and Republicans like it. The car companies and the United Auto Workers union (UAW) accept it. Environmental groups applaud it as a potential breakthrough -- the first increase in federal fuel economy standards in more than two decades if approved by the Senate and signed into law by the White House... We consumers like the legislation because, as was the case with the first CAFE law in 1975, the House bill requires us to do nothing for fuel conservation -- zip, zilch, nada.. !!! ... Thus, the bill passed last week by the House effectively reinforces the tenet of original CAFE law. To wit: We can have our oil and guzzle it, too. And we can do both at the lowest fossil fuel prices in the developed world while pretending to be acting in defense of the environment... Therein is the grand fraud for which we all will pay dearly if we swallow this proposed new serving of CAFE as eagerly as we gulped the old mixture... The problem is that endless growth is a myth. History shows us as much. Empires rise. Empires fall. Observe the debris of our real estate market, the sad legacy of an empire built on property-flipping supported in large measure by bogus subprime loans. Has it not been proved that any market built on flipping is destined to flop?... Likewise, do any of you believe that oil is inexhaustible, that we can replace it easily and cheaply with alternative and renewable fuels, that we can develop easily and cheaply a safe and effective infrastructure for delivering those new fuels, that we can save petroleum by making car companies produce more fuel-efficient cars and trucks, or that we can increase oil production by stripping federal tax supports from petroleum companies while we, the American consumers, content ourselves with doing nothing, or not paying anything extra for improved fuel efficiency and energy conservation?... Put another way: Can we really solve a two-part equation involving industry and consumers by working only the industrial side?...

Some regions could receive up to a foot of snow, forecasters said... The storm was blamed for 35 deaths, mostly in traffic accidents, as it moved through the middle of the country on its way to the Northeast. According to Maurice Fitzpatrick, a senior manager at leading business and financial advisers Grant Thornton, the Chancellor could afford to reduce fuel duty by around 7p a litre... He reckons that the Chancellor has received an additional £3.6 million from higher North Sea oil and gas prices... “Record high international oil prices combined with petrol and diesel reaching £1 at the pump is set to generate an extra £300 million per month for the UK Treasury", he says... But, he adds “the Treasury is probably more inclined to use the additional revenue to finance its increases in public spending and to reduce its borrowing, which is already overshooting its target this year"... So the Government should be able to afford to cut 7p off fuel duty but it will not do it because it has already spent too much...

This week MT, in association with Barclays Commercial, publishes the Top 100 - and the average data highlights how maintaining the financial health of a transport business has become ever more difficult... While the average turnover increased from £107m in 2006's Top 100 to £141m, average profit dropped from £2.7m to £2.5m. Almost needless to say, the average return on sales got worse too: dropping from 4.05% to 2.78%... Now compare these figures with those in our front page story. Driver pay levels are up 4.5% - ahead of inflation, the rest of the industry and the UK economy as a whole. According to Incomes Data Services, this is due to "efforts to resolve recruitment and retention issues and to compensate drivers for loss of earnings through restrictions on working time". It's no wonder the major employers in transport are already warning union negotiators to be sensitive to the pressures they are under: pay talks for 2008 and beyond will be pitched battlegrounds...

USA -Fleet Owner, by Skilcarr -14 Dec 2007: -- ... “FMCSA is continuing to allow large trucks to roll like time bombs on our highways,” said Joan Claybrook, president of Public Citizen, in a press release responding to the agency’s decision. “With its action today, the administration has shown that it is willing to risk carnage on the highways to boost the bottom line for big corporations. We urge the agency to draft a rule based on science instead of industry politics – a rule that will protect truck drivers and those of us who share the road with them. To do otherwise is the height of insanity”... Under the old rules, a driver looked at a 15-hour workday that could be indefinitely extended by logging breaks. Now, they work a 14-hour day – one hour shorter than before – and the clock CANNOT be stopped. Drivers used to face five hours of non-driving on-duty time – now they only face three. They used to get just eight hours off; now they get 10, a full two hours more. But by just adding one extra hour of drive time, going from 10 to 11, the so-called safety groups are willing to throw the whole smash out and go back to the old rules – rules created way back in 1933, when they didn’t even conduct sleep studies, much less envision global supply chains... Many drivers aren’t happy with the revised rules because they feel they can’t take a break: that with the clock running, they need to drive or risk losing pay if they stop for a rest break. USA -Life on the Roads, by Wayne Weisser -Dec 13, 2007: -- Looks like we’re stuck with the HOS rules as they are right now. 11 on 10 off with a 34 hour restart. If I’m out here working, I want to be working instead of waiting for hours in a truck stop!... I’m a little confused. If the Court decision isn’t until the 27th, what’s the FMCSA coming out with their “interim final rule” now for?... The sweatshop conditions until recently had nothing to do with driving. What’s wrong with the driving rule now is that I have to finish my 11 hours of driving within 14 hours. If you stop it has to be under three hours or over 8 hours or not at all. That’s the problem with the newer rules. When my wife was driving with me, the driver had to drive their 11 hours straight even though there was a rested driver sitting right behind them. That was nuts! And a lot of team loads don’t have time for a long break because one driver is tired...

The chief executive of the Australian Trucking Association, Stuart St Clair, says the reforms are needed. But they must be realistic, particularly in situations like Queensland, where demerit points extend to minor offences... He says the group would like to see a defence for drivers who are unable to get off the road safely... Queensland and Victoria are building more rest stops and other states will follow. Australia -Supply Chain Review -December 14, 2007: -- The Australian Trucking Association (ATA) has backed the National Transport Commission’s (NTC) proposed reforms to heavy vehicle accreditation — and called for a 50 percent discount on registration fees for accredited operators... The NTC is proposing to establish a national panel of regulators and industry representatives to oversee a single new accreditation framework. The panel would certify private sector accreditation schemes, such as TruckSafe, to agreed national standards... The NTC has also flagged discounts for accredited operators in registration and fuel charges. The ATA will argue accredited operations should receive a 50 percent discount on registration fees along with a discount in fuel charges... Clunie says his understanding is that most of those Filipino workers who handed in their notice in the past month are being hired by Siemens Transportation Group Inc., the parent company of Kindersley Transport and its flat bed sister company, Edge Transportation... Clunie says he's upset enough to investigate if there are legal options to recoup what he says are $13,500 in costs incurred by Kelsey Trail in recruiting each Filipino driver, including air fares, settlement costs and training expenses...

A little-known Gold Coast City Council law requires all truck owners to apply for a permit to park vehicles on their own property... Owners must meet strict criteria to win approval — from vegetation screening of the truck to engineer-approved driveways to the ability to drive in and out without reversing. Owners must also seek approval from their neighbours as part of the application...

U.S. long-haul truck drivers can continue to spend as much as 11 hours a day behind the wheel

Houston,TX,USA -The Houston Chronicle/Bloomberg News -Dec. 11, 2007: -- ... after a federal agency refused to return to lower limits sought by safety advocates... The U.S. Transportation Department, in an interim rule issued Tuesday, sided with the trucking industry and upheld a 2004 increase in daily driving time from 10 hours. The rule also keeps a 14-hour daily limit for drivers to be on duty... The rule is a win for the American Trucking Associations trade group, whose members include United Parcel Service and YRC Worldwide. Trucking companies said shorter workdays boost costs by requiring more drivers to move the same amount of freight, while consumer groups such as Public Citizen say drivers who work fewer hours are less likely to have accidents... The new rule also permits drivers reaching 60 hours on-duty in seven days to return to work after 34 hours. Before 2004, they had to wait out the seven-day period... Public Citizen will challenge the rule in court if the final version retains the longer hours, said Joan Claybrook, president of the organization. Regulators may publish the final rule next year, she said...

Over a 72-hour period, between Tuesday, December 4, and Thursday, December 6, seven crashes involving trucks were recorded by paramedics and traffic department officials on a stretch of the N3 in KwaZulu-Natal... 'Truck drivers are not meant to travel between 11pm and 4am in terms of the law... Road Traffic Inspectorate spokesperson Colin Govender said the crashes were causing much concern as "we are not even halfway into December and already the numbers are high"... Many of the accidents involved drivers, travelling mainly on the N3, losing control of their vehicles, veering into oncoming traffic and colliding head-on with other vehicles. One such crash last week involved a truck travelling on the N3 near the Tugela Toll Plaza going out of control and veering into oncoming traffic... MEXICANS' TRUCKS * USA - No truck with border traffic

USA -The Financial Times Limited (UK), by Laura Dixon -December 12, 2007: -- ... According to Armando Chacón, investigations director at the Mexican Institute for Competitiveness, improving border facilitation and the movement is vital for the economic success of the region... At the moment, the average waiting time for those carrying cargo during peak hours is five hours... The Institute estimates that reducing the waiting time for all transport at the border by 75 per cent would save $513.3m per year... In response to vocal opposition to the project, the US authorities have promised "each lorry that crosses the border as part of the pilot programme will be checked ...every time"... The plan has not passed without criticism in Mexico either... Canacar, the national chamber representing some 5,000 cargo transport businesses, petitioned the government to postpone the plan, alleging that the conditions were unfair to Mexican businesses... The difficulties of the project could be seen in the take-up. Only four US companies have so far been authorised to travel into Mexico, with 41 vehicles between them. The nine approved Mexican companies have 47 vehicles... And there have been other teething problems... Transportes Olímpicos has had to send a replacement to the frontier when the original driver was turned away for not having good enough English... Mexican companies are also vulnerable to higher insurance costs... But, with cross-border traffic from Mexico to the US reaching 4.8m crossings in 2006, the plan has found numerous supporters... The Mexican Institute for Competitiveness estimates that improved efficiency on the border could be worth between $31bn and $40bn. Some 73 per cent of cargo from Mexico to the US goes by truck... Scott McLaughlin, president of Stagecoach Cartage and Distribution, one of the four US companies licensed under the scheme, has made some 70 trips from the US to Ciudad Juárez, just over the border, and one to Obregón on the Gulf of Mexico... "I think the plan has gone marvellously so far," he says... Some believe that for Nafta to be able to compete in an increasingly competitive world, permanent improvements to crossborder transport are unavoidable...

MD Stuart Hunt says: "That won't reflect in our market share this year, which I expect to be slightly down on last year's level of 28.8% at about 27.5%... But it still means we will register some 90% more trucks than our nearest rival, and remain market leader in every significant truck market sector"...


* Germany - MAN benefits from credit turmoil
Germany -The Financial Times (UK) -11 Dec 2007: -- MAN is still expecting growth next year after record results due this year... The comments came as Mr Hakan Samuelsson, chief executive urged politicians across Europe to allow longer trucks to enable truckmakers to cut carbon dioxide emissions... Trucks in most European countries are allowed to be up to 18.5 metres long but Mr Samuelsson called for an extension to 25m. He stressed though that it was more about increasing length than increasing weight. "It doesn't have to be the 60 tonne gigaliners"... Mr Samuelsson said orders at MAN had risen 24 per cent in the first 11 months with revenues up 14 per cent - both slightly ahead of the nine-month level - on the back of booming demand for trucks in eastern Europe...

Yes it's another one of those Chinese truck makers, this time the Baotou Beifang Benchi Heavy-Duty Truck Company Ltd. which, according to its website "....is one of the famous domestic top-class heavy-duty truck manufacturing companies in China." And by the looks of it they have some kind of agreement going with DaimlerChrysler whereby they (BBBHDTCL) build their own trucks with a variety of different engines but with a version of the old SK 'Powerliner' cab range... Shanghai,China -The Financial Times (London,England,UK), by Geoff Dyer -December 10 2007: -- China’s spectacular economic development record has largely been concentrated in two areas – the so-called Pearl River Delta just north of Hong Kong and the immediate hinterland of Shanghai... That process is starting to change, however. Over the past few years, labour costs have started to rise sharply in these coastal areas, threatening the competitiveness of lower-margin operators. Meanwhile, as these regions have prospered, they have become less tolerant of the pollution rapid industrialisation has created... The key will be the quality of logistics available to them in those more inland areas... To encourage such investments, the government has been spending heavily on new road infrastructure in recent years. China has just over 45,000km of highways and the authorities plan to nearly double the total to 85,000km by 2010... Yet companies wishing to move goods around by road quickly face the dilemma that there are no national trucking networks. Instead most of the country is dominated by small trucking operations, often with old and inefficient vehicles, that cover only limited regions. The journeys are tough on drivers' health, as they breathe the exhaust of trucks ahead of them... "When a truck driver is not eating rice, he's eating diesel," said Zhang over a dinner of rice and vegetables at a grimy café here as his brakes were repaired... Wearing blue jeans and a dark pullover and chain-smoking cigarettes, like many of the truck drivers here, Zhang was frank about both the problems truckers face and the problems their vehicles create... Overweight trucks damage roads and emit extra pollution. But Zhang said that he frequently exceeded weight limits on his blue five-month-old Chunlan truck... With his pay based on how much cargo he hauls, he estimated that he typically carries two to three times his truck's legal limit... Time on the road is hard on relationships, too. Zhang has a wife and a year-old daughter. But he takes another woman with him on many of his trips as a second "wife," he said, insisting that his legal wife accepted the arrangement... Oil industry experts suggest that China raise diesel prices by at least 20 percent to eliminate subsidies and fuel lines and to foster refinery investment. Zhang, who pays the equivalent of $680 a month on his truck loan, vehemently opposes an increase in diesel prices; he is convinced that he would not be able to pass on the extra cost to the manufacturers who hire him... One response to China's truck-pollution problem would be to ban older trucks. But the government has resisted such a radical step, fearing the costs not just to the economy, but to truckers and members of their extended families, who typically pool their savings to finance a truck... * European Automakers Likely to Build Plants in United States

Detroit,Mich,USA -The New York times (NY,USA), by NICK BUNKLEY -December 11, 2007: -- The dollar’s falling value is making European automakers eager to build more vehicles in the United States, even as American car companies continue to shift production to other, lower-cost countries...

* Fiat, the Italian carmaker, is the latest company to suggest that it may build a plant in the United States. Its Alfa Romeo is returning to the United States next year after a 13-year absence.
* Volkswagen of Germany is scouting locations for a plant in the eastern United States. It was the first foreign carmaker to open an American factory, in New Stanton, Pa., but closed the factory in 1988...

Fiat and Volkswagen are mass-market European brands, as opposed to BMW and Mercedes-Benz, which operate luxury car factories in the American south. Analysts said the arrival of Volkswagen and Fiat could lead others, like the French companies Renault and PSA Peugeot-Citroën, to move production to this country as well, if the euro remains strong... Both BMW and Mercedes, which began building vehicles in the United States in the 1990s, are expanding American production in response to the dollar’s falling value against the euro... The euro traded at $1.4712 Monday in New York, slightly below the record high set last month. A slowing American economy has accelerated the dollar’s fall against the euro this year... A recent study by the Center for Automotive Research in Ann Arbor, Mich., conducted before the dollar’s latest period of decline, found that autoworkers in Western Europe were earning nearly $10 more an hour than their American counterparts...

Rome,Italy -CNN (USA) -December 12, 2007: -- A strike by Italian truck drivers that has caused shortages of food, fuel and medicine across the country has ended -- at least for now... A spokesman for Italy's government told, the strike was called off after a Wednesday meeting between government and labor leaders in which the government made an offer to settle truckers' grievances... Representatives for labor unions represented in the strike, however, said the strike has merely been suspended... They said union leaders wanted to talk to members before accepting what was described as a "take it or leave it" offer from the government... REGULATIONS * USA - Stricter auto emission rules by states upheld

The auto industry lost another court battle in its bid to stop California and at least 12 other states from imposing a 30 percent reduction in vehicle tailpipe emissions by 2016

Washington,DC,USA -The Detroit News, by David Shepardson -December 13, 2007: -- ... In a 57-page opinion issued Tuesday, U.S. District Judge Anthony Ishii said California and the other states that have adopted stricter emissions rules than the federal standards can do so, throwing out a challenge by Detroit automakers... Judge Ishii's decision follows a trial in Vermont, which also allowed states to impose their own emissions requirements... California is still waiting for a waiver from the Environmental Protection Agency to impose the rules beginning with the 2009 model year that starts next fall. The EPA has said it will issue its decision before the end of the year... Under the Clean Air Act, California is the only state that can set its own vehicle pollution standards, because it started regulating air pollution before the U.S. EPA was created. Other states are free to choose either the California rules or the federal government's... The automakers contend that by 2010, California-style regulations would reduce sales by up to 10,800 vehicles. California says that by 2020 its regulation could reduce sales by 4.7 percent... Environmentalists praised the ruling...

Tire makers are swiftly adding capacity in China, gearing up for the expanding domestic market and for exports

* Triangle Tyre Co., a domestic company, will increase annual production by five million passenger car tires in 2008. It makes 15 million per year now.
* Cooper Kenda Tire (Kunshan) Co. has started exporting passenger car tires. By the end of 2008 the company says its new plant will be making and exporting close to 3 million tires per year... The 50-50 joint venture of Cooper Tire & Rubber Co. and Kenda Rubber Industrial Co. began tire shipments to North America a few months ago...
* Continental Tires of Germany, is also expanding in China... Continental Tires (Shanghai) Co. is planning to build a 150 million euro (1.64 billion yuan) plant in Hefei City in Anhui province. Tire production is expected to start in 2010. The plant will have a final annual capacity of 4 million tires, though, it will take some years to reach that, says Kreipe.

* Pirelli begins passenger-car tire production

Shanghai,China -Auto News, by Namrita Chow -12 Dec 2007: -- Pirelli Tyre Co.'s $100 million (741 million yuan) passenger-car tire plant began production Nov. 27... Daily production at the 70,000-square-meter site in Yanzhou, in Shandong province, is currently more than 5,000 tires a day, says Giuseppe Cattaneo, CEO of Pirelli Tyre Co. (China). The company also is based in Yanzhou... The plant has an annual capacity of 3 million tires, which it will reach by the end of 2008, Cattaneo says...

The research group conducted the tests with the cooperation of Robert Transport and Cascades Transports in October. The objective was to validate fuel-saving claims on a wide variety of components and devices... Some of the technologies proved to exceed expectations. Wide-base super-single tires showed a 10% fuel savings during the test. Aerodynamic technologies also improved fuel mileage by up to 7%...
