TRUCKING INDUSTRY * USA - FedEx Wins Court Ruling in Employee Classification Case

Indianápolis,IND,USA -Transport Topics -24 Aug 2010: -- A federal judge in Indiana ruled that drivers at FedEx Corp.’s ground delivery unit in Kansas are contractors and not employees, handing the package company a victory in its ongoing litigation with drivers from across the country about employees’ classification... In a separate ruling handed down by Judge Robert Miller, in the U.S. District Court for the Northern District of Indiana, drivers in nearly a dozen other states that are also suing had their cases remanded back to state courts for further consideration...


* California - Phase-in help for meeting CARB GHG mandate

Sacramento,CAL,USA -Penton Media/Fleet Owner, by Sean Kilcarr -Aug 20, 2010: -- The California Air Resources Board (CARB) has put together several “phase-in” plans to help fleets comply with its heavy-duty tractor-trailer greenhouse gas (GHG) regulation mandate that went into effect Jan. 1 this year – giving small fleets, in particular, a nearly seven-year window to meet the new rules if they participate in the state agency’s program... During a conference call with reporters reviewing the GHG compliance efforts undertaken by Tacoma, WA-based carrier Interstate Distributor Co., Yvonne Sanchez, an air resources engineer with CARB, explained that small fleets – those with 21 vehicles or less – operating equipment governed by these new regulations have until July 1, 2012, to submit a compliance plan to CARB to gain the phase-in designation...


* Pennsylvania - L&H Trucking Files for Bankruptcy Protection

York County,PA,USA -The Journal of Commerce Online, by William B. Cassidy -Aug 20, 2010: -- The recession isn't over for many small trucking companies. While larger competitors report record volumes and stronger bottom lines, many smaller carriers are still struggling to stay in business... L&H Trucking, a family-owned trucking outfit in Central Pennsylvania, filed for Chapter 11 bankruptcy protection this week... The company, which offers truckload and intermodal drayage services with more than 165 tractors and 700 trailers, listed $10 million to $50 million in debt and up to $10 million in assets in its filing... Chapter 11 provides protection from creditors for bankrupt companies as they reorganize, and companies usually continue to operate. A call to L&H Thursday found the company still operating...


* S. Virginia -FWC, shut down last week

Lynchburg,VA,USA -The Journal of Commerce Online, by William B. Cassidy -Aug 20, 2010: -- A smaller truckload carrier in Southern Virginia, FWC, shut down last week, ending a 30-year run. The company, located, had 75 employees, and about 60 tractors and 210 trailers... Company officials did not return calls seeking comment. Other trucking companies were already recruiting FWC drivers, according to local news reports...
