ATA charges district court should have outlawed concession agreements

Los Angeles,CAL,USA -The Journal of Commerce Online, by Bill Mongelluzzo -May 18, 2009: -- The American Trucking Associations has challenged the April 28 decision by the U.S. District Court in Los Angeles to allow certain provisions in the Los Angeles-Long Beach clean-trucks concession programs to remain in effect... In papers filed at the weekend with the U.S. Court of Appeals for the 9th Circuit, the ATA charged that the district court should have found the concession agreements in their entirety to be illegal... Judge Snyder enjoined several provisions in the concession agreements, including the main target of the ATA, Los Angeles' requirement that concessionaires eventually use only employee drivers. The Teamsters union, which is attempting to organize harbor truck drivers nationwide, pushed for the employee driver mandate... However, Judge Snyder declined to enjoin a number of other provisions, some of which ATA charges are not responsive to motor carrier safety. ATA charges that in doing so she committed errors of law... Due to those errors, the concession requirements in their entirety should be enjoined, ATA charged...
