COURT RULES * Northern Ireland/UK - Haulier awarded £65,000

Belfast,N.Ireland,UK -HGV (Ireland) -7 June 2009: -- A Northern Ireland haulier has been awarded £65,000 after winning a case against the Environmental Health Services (HES) at the High Court in Belfast... Patrick Laverty of Ballymena based RGC International, sued the HES over the detention of three HGVs taking waste from Dublin to Belfast... The Court ruled that the trucks were taken illegally from him by officials who were concerned about a landfill destination and then taken to facilities where the waste was removed and examined without anyone acting for the company... The trucks had been transporting waste from two business premises in the South Dublin County Council area to Amber Merchants Ltd, trading as Waste Beater Unit at Kennedy Way Industrial Estate, Belfast...

US Court Ruled * USA - Retailer not exempt from paying truckers overtime

Trenton,,N.J.,USA -Today's Trucking (CAN) -4 March 2009: -- A New Jersey Appeals Court ruled that a furniture retailer cannot take advantage of the trucking exemption in the state's overtime pay laws to avoid paying its delivery workers time-and-a-half when they work more than 40 hours a week... Raymour and Flanigan, a retail furniture business, also operates customer service centers and distribution centers, where it stores and warehouses its goods, then transports those goods by truck to customers... The three-judge appeals court ruled against the furniture company, saying, "Extending the exemption to retail industry employers, who conduct their delivery operations at a separate location, would be contrary to the purpose of the wage and hour legislation to protect the health and welfare of employees," the court ruled. "It would allow a retail business employer to avoid paying time-and-a-half of the employee's regular wage simply by placing the trucking and delivery operation of its business in a separate building."...

Determination * USA - California court rules in favor of FedEx Ground drivers

FedEx Ground drivers to be employees and not independent contractors

Los Angeles,CAL,USA -The Trucker -17 Aug 2007: -- On August 13, the California Court of Appeals upheld the trial court's decision finding FedEx Ground drivers to be employees and not independent contractors, thus denying the appeal of FedEx in the Estrada vs. FedEx Ground Package System Inc... The appeals court also determined that the FedEx Ground drivers were entitled to reimbursement for approximately $6 million in additional expenses, bringing the total damages to about $11 million for 200 drivers...

Appeals Court * USA - "Company not required to pay tax on trucks"

A trucking company with headquarters in Alabama should not have been required to pay more than $900,000 in state use tax for trucks that were originally delivered to a terminal in Ohio

The Alabama Court of Civil Appeals ruled that Boyd Brothers Trucking, with headquarters in Clayton, should not have to pay use tax on the trucks when only a small amount of their usage was in Alabama... The attorney for the trucking company, former state Revenue Commissioner Jim Sizemore, said the ruling will effect the state's ability to tax other trucking companies whose vehicles occasionally travel through or make deliveries in Alabama...
