* Drome - Criminal court dismisses case against Norbert Dentressangle managers
--- The Criminal Court of Valence, in south-east France, had dismissed a case against six managers of XPO Logistics/Norbert Dentressangle (ND) for ‘unlawful loan of labour’ and ‘illegal sub-contracting’ ... The former group Norbert Dentressangle was prosecuted for "illegal loan labor for profit under the guise of sub-contracting operations, illegal subcontracting and illegal labor." Facts disputed by the former leaders of the group who pleaded reports of European subcontracting... The pieces that remained in the record did not provide sufficient evidence to allow the court to accept the existence of permanent subordination between, on one side, drivers Romanian, Polish and Portuguese and the other, the companies of the Norbert Dentressangle group. The general release has been issued for the six defendants indicted in the case, and in respect of the offending companies (ND Shiloh TND Volumes and SAS TND)... Contacted by The Official Carriers , the new direction of the group passed under the American flag in April 2015 since its acquisition by XPO Logistics, has merely stated: "The Company welcomes the decision that was taken by the Criminal Court Valence, which is fully entitled to the arguments of the defense" ... France's public prosecutor, who at the trial in March had called for three-year suspended prison sentences and fines totalling €45,000 be handed to the managers, is planning to appeal... The court indicated at the conclusion of the trial that it would render its verdict at the end of May...
