Long Beach,CAL,USA -The Cunningham Report -11 April 2009: -- Armed with an order from the 9th Circuit Appellate Court, the American Trucking Associations is asking Judge Christina Snyder not to cherry pick which parts of Port of Los Angeles and Port of Long Beach concession programs to enjoin, but to ban them in their entirety... The Appellate Court, in the ruling it handed down last month noted that many elements of the ports' programs - such as the Los Angeles requirement for all drivers to be employees and its restrictions on street parking of trucks - would probably be overturned and ordered Judge Snyder to grant a preliminary injunction to the ATA. That ruling left it up to Snyder whether or not to enjoin the ports' entire concession programs or just portions of each...
