TRUCKERS WARN * USA: Insurance companies tell who can and cannot hire for offenses

* Ohio - Truckers unfairly impacted by personal driving record


-- Life a truck driver means making the right decisions at work and at home. It starts by obtaining the right license, depending on what you plan to drive. This process can be costly and take weeks. Then you see a qualified doctor for a federal examination. After that you’re off to seek out an employer in which it all comes down to their insurance company whether you get the job. Great, you’re hired and rolling down the road. You say, “What’s hard about that? It’s an 80,000 pound, 65 foot truck” ... A big percent of these drivers have millions of safe miles and hours crisscrossing the country driving through the most congested cities in the country. Maneuvering through places big enough for pickup trucks and thinking about being away from family...  At the same time, what’s not understood is that anyone can go and rent a large U-Haul with a pull-behind trailer or buy a large motor home with a pull-behind trailer. These vehicles are as large as that semi truck. The outcome ban be the same in an accident. State and federal laws, however, are not the same for these vehicles... If a truck driver is convicted of an offense in their own personal vehicle – the same offenses everyday people, even county and state officials, are convicted of – the trucker has to report this to their employer’s insurance where they pass down their sentence. This can be a real gamechanger, sometimes for years. The big picture here is the truck driver’s employment is affected by the insurance company’s decisions while the employment of everyday people is not affected... These insurance companies are running these trucking companies by telling who they can and cannot hire for offenses that occurred in their personal vehicles and are not work related. Years of no accidents and no violations while driving for a living means nothing...

CDL HOLDERS * USA - Kentucky sends one letter, suspends CDL privileges for many

5,000 to 8,000 Kentucky CDL holders may be driving under suspended licenses

Springfield,KY,USA -Land Line Magazine, by Charlie Morasch -July 16, 2008: -- Maria Arnold was stunned to hear the news from a potential employer... The state of Kentucky had suspended her commercial driver’s license so the carrier couldn’t hire her, the manager of a trucking company told Arnold... Arnold later learned the state had sent a letter in May to her home address – not her post office box – while she was out on the road... The Kentucky Transportation Cabinet recently suspended an unpublicized number of CDLs just 30 days after mailing a request for information to CDL holders... Agency spokesman David Devers said the Kentucky General Assembly required that certain 10-year driving record information be added to CDL applications by 2005. CDL holders were recently notified if they hadn’t submitted the applications, Devers said. Those drivers’ CDL privileges were then canceled “until we do receive it” Devers said... “Anyone who has a question about this matter can call our CDL section at the Kentucky Transportation Cabinet at (502) 564-0280,” Devers said... Arnold said her CDL was quickly reinstated – without a fee – after she called and faxed information to the state...

TRUCKERS' CDL * USA - FMCSA proposes rule to close loopholes in permit process

Illegal immigrants, drivers with bad records, and others who may look to capitalize on loopholes in the commercial driver’s license permit regulations won’t be getting away with it much longer if a proposed reg is adopted

The Federal Motor Carrier Safety Administration published a “notice of proposed rulemaking” in the Federal Register on Wednesday, April 9, that seeks to close up loopholes and address shortcomings in the current process... In addition to setting new minimum standards in the permit process, the proposed rulemaking seeks to revise the CDL knowledge and skills testing... The public has until June 9 to file comments on the proposed regulation. The Docket number for the proposed rule is FMCSA-2007-27659. Click here to comment online... Of course, submitting comments electronically via the Internet isn’t your only option...

Commercial Driver’s License * USA - Department of Transportation to conduct CDLIS audit

Washington,DC,USA -eTrucker, by Kristie Busam -14 Dec 2007: -- The U.S. Department of Transportation's Office of Inspector General plans to initiate a performance audit of the Commercial Driver’s License Information System as required by the Safe, Accountable, Flexible, Efficient Transportation Equity Act –- A Legacy for Users (SAFETEA-LU)... There are more than 700,000 active motor carriers in the United States under the jurisdiction of the Federal Motor Carrier Safety Administration, with more than 13 million CDL holders on record and an estimated 2.7 million CDL holders with hazardous materials endorsements... The records of these commercial drivers are stored in CDLIS, which is used by each state to track CDL holders... The audit will be conducted at FMCSA headquarters, the American Association of Motor Vehicle Administrators' CDLIS contractor sites, and selected state motor vehicle administration offices...

Drivers' Licenses * USA - Oregon governor committed to permitting illegal immigrants to drive

OR,USA -Associated Press /Land Line Magazine, by Keith Goble -November 16, 2007: -- Oregon Governor said he still is in favor of making it more difficult for people to get licenses to drive in the state and elsewhere... Currently, applicants for an Oregon driver’s license can obtain the document without presenting proof of identity, such as a birth certificate or Social Security card... The governor said the proposal would bring the state into compliance with new federal ID requirements that states adopt a national standard that includes linking their driver’s licensing records to national databases... The license for those who provide proof of “legal presence” would be valid at airports, banks and other locations that require identification. Individuals who cannot provide proof of their legal presence could use the other license only for driving. It would be stamped “not for identification”...

Big Flaws * USA - Found in national driver’s license database

Washington,DC,USA -Land Line Magazine -November 1, 2007: -- The national register of information on driver’s license holders – including CDL holders – that’s maintained by the National Highway Traffic Safety Administration has some big flaws, according to a government audit... In a press release, the U.S. Department of Transportation Inspector General announced that personal information in the database, such as drug or alcohol convictions, could be accessed and used by unauthorized parties... The inspector general also reported that information on convictions sometimes takes more than a year to be entered into the register, that physical characteristics – such as hair and eye color – were missing from 18 million records, and that 161,000 cases of duplicate social security numbers were found...

* Canada - BCTA clears hurdle towards provincial driver training standard

BCTA wants ITA approved driver trainees distinguished from regular class 1 licence holders

Vancouver,BC,Canada -Todays' Trucking -15 Oct 2007: -- The B.C. Trucking Association says it is one step closer to achieving a minimum, non-mandatory professional driver-training standard after it received approval in principle by the Industry Training Authority (ITA)... The ITA is a provincial government agency that oversees the B.C. industry training and apprenticeship system. A minimum professional driver training standard is one of the main objectives of the BC Trucking Human Resources strategic plan. It allow access to student funding for trainees. Graduates would also be more likely to have the necessary skills to enter the trucking industry and be successful, says BCTA... Even when a minimum training standard is achieved, individuals would still be able to obtain a class 1 without training by challenging the licence test...
