"TERMINALS CONSPIRING TO DESTROY DRIVERS" * USA. COMPLAINT AGAINST CONTAINER TERMINALS

* California - Truck drivers sue container terminals at ports of L.A./Long Beach


--- A group of 31 truck drivers filed a complaint against a half dozen container terminals or shipping lines at the ports of Los Angeles and Long Beach, claiming they were denied access to terminals during Teamster-led strikes... It said the companies named in the lawsuit “acting in concert with the Teamsters, denied access and locked out only the plaintiff owner operator drivers and not other trucking companies’ drivers or union drivers” for up to three days... The lawsuit accused the terminals of conspiring to destroy the drivers' businesses and denying their “constitutional rights to earn a living” ... The plaintiffs said they have suffered losses of at least $120,000. Consequently, they have asked for an injunction against the terminals and their employees for denying access to the terminals, and a civil penalty of $2,500 against each terminal and each individual defendant for each violation of a provision in California's Unfair Competition Law... They have also asked the court to "assess additional civil penalty for conspiracy against trade" in the amount of $1 million against each defendant terminals and each named individual defendant... The companies named in the lawsuit include: Everport Terminal Services, Pacific Container Terminals, APM Terminals, Maersk Line, California United Terminals and SSA Terminals/Shippers Transport...

* Queensland - More than 40 witnesses to testify at manslaughter trial of trucking proprietor Peter Francis Colbert

Brisbane,QNLD,Australia -Courier Mail/The Advertiser, by Ken McGregor -Dec 01, 2014: -- More than 40 witnesses will give evidence at the trial of a trucking company owner accused of manslaughter over the death of one of his drivers, a court has heard... Peter Francis Colbert has pleaded not guilty to manslaughter over the death of Salisbury father-of-two Robert Brimson, 45...

Mr Brimson died after the truck he was driving crashed into a road sign on Main South Rd, Happy Valley, in March this year... Colbert has also pleaded not guilty to two counts of endangering life... It is alleged Colbert, 55, of Athol Park, failed to act on warnings from his drivers about brake failures before the fatal crash on March 7... Prosecutor Elizabeth Griffith today told the District Court more than 40 witnesses were expected to give evidence during the trial, which would take at least four weeks... Grant Algie, SC, for Colbert, agreed the matter was “legally complex” and should be heard by the Supreme Court rather than the District Court... Judge Simon Stretton sent the matter to the Supreme Court where the it will be heard later this month...


 * New South Wales - “Urgent change in regulation” to close trucking loophole 

Sydney,NSW,Australia -Drive com au, by David McCowen -December 1, 2014: -- The NSW Government will swiftly close a loophole that poses a "serious safety concern" by allowing untrained mechanics to work on heavy vehicles... Under the Motor Dealers and Repairers Act, which came into effect from December 1, unqualified workers are allowed to service and repair trucks and buses over 4.5 tonnes... The changes had been described by industry bodies such as the Transport Workers Union as "a serious safety concern for the entire community"... Michael Aird, a senior official for the TWU, says "poor maintenance of heavy vehicles is a big factor in the hundreds of fatal truck crashes on Australian roads each year"...
