* Massachusetts - Trucker tax another Deval leftover issue
-- Do you like leftovers? Every week we find another Gov. Deval Patrick leftover problem... During his tenure, the state’s Department of Revenue decided to retroactively tax trucking businesses — though DOR’s own ruling at the time said that the businesses were exempt... Why should you care? To begin, 91 percent of all goods in Massachusetts are delivered by truck. If truckers pull out of the commonwealth, it will be impossible to get goods or the cost of shipping consumer products will go through the roof. It will hit us hard in our wallets... Under the Patrick regime, DOR started demanding sales and use tax on rolling stock — trucks and trailers that are purchased out of state but used, housed or fixed within Massachusetts. It’s important to note that the appropriate taxes on the equipment were paid in other states, if those states tax them. These truckers, along with their accountants, believed that they were abiding by Massachusetts taxation regulations... Fortunately for truckers, the Supreme Judicial Court has previously ruled that it is unconstitutional to retroactively tax people! ... Patrick’s overreach on taxation was trounced in the Town Faire Tire ruling. It will be again! ...
