* Queensland - Contracts surprises if trucking operators don't read what they are signing up for


-- Trucking operators need to ensure they know what customers are trying to make them liable for... Companies high up the supply chain will try and dump all responsibilities for on-road compliance on trucking operators, according to a specialist transport lawyer, prompting a warning to the industry to pay close attention when signing contracts. Many customers use written contracts to ensure compliance with the ’all reasonable steps’ provision under COR (Chain of Responsibility)... The provision require all parties in the chain to take necessary steps to prevent breaches relating to driver fatigue, vehicle speed and a vehicle's load, mass and dimensions... But even if contracts detail the responsibilities of each party, there is no guarantee a company or an individual will still be able to demonstrate they took all reasonable steps if a COR breach occurs... This is because there is no clear definition of ‘all reasonable steps’, but Bristow is hopeful planned changes to COR will address this...

* Queensland - Electronic work diaries get committee green light

-- Amendment Bill will allow implementation of electronic diaries and new penalties... Truck drivers will be able to ditch paper-based reporting once electronic work diaries are introduced... Legislative amendments to pave the way for the use of electronic work diaries (EWDs) and penalties for EWD breaches are a step closer to being passed... Queensland’s Infrastructure, Planning and Natural Resources Committee has recommended the state’s politicians support a series of amendments to the Heavy Vehicle National Law (HVNL) to allow EWDs to be implemented... The HVNL applies throughout Australia except in Western Australia and the Northern Territory...

* Northern Territory: Gets permanent open speed limit

-- Heavy vehicles travelling on the Sturt Highway in the NT may have to get used to being overtaken by smaller cars. Chief minister Adam Giles and transport minister Peter Chandler have confirmed a 336 km stretch of the road – between Alice Springs and the Ali Curung rail overpass – will have a permanently open speed limit... It follows a 16-month trial of open speed limits across two sections of the road, totalling 276km... Giles says the trial showed drivers took great responsibility for safety... There were 11 crashes recorded during the trial, but no fatalities and no indication of speed as a causal factor, he says... Chandler says the open speed limit is evidence of the government fulfilling its pledge to give more responsibility to people to behave safely... "The NT has a unique road network with long distances between towns and low traffic volume. With the expansion of open speed limit zones, we are putting responsibility on motorists to drive to their own capabilities and to the conditions of the road," he adds... Heavy vehicles remain limited by local restrictions in the open speed zone, which set the maximum speed at 110 kmh...

* Queensland - Brisbane Auction sees Heavly Haulage Australia assets go (or THE END FOR A TRUCKING Co.)

-- The assets of defunct trucking firm Heavy Haulage Australia (HHA) have gone to auction in Brisbane. The fleet of the once mighty trucking company have gone under the hammer... HHA went into administration in June and closed its doors one month later, with more than 70 people in Brisbane, Toowoomba, Pert and Port Hedland losing their jobs as a result... All up, assets comprising 50 prime movers, 120 heavy haulage trailers, 15 cranes and 40 pilot and light commercial vehicles are being offered for sale... The Brisbane auction featured near-new Western Stars, along with multiple Kenworth models, a Peterbilt, an Iveco Powerstar and a Scania 144... Iron ore price and mining woes sucked life from efforts to save firm as a going concern...
