Injunction will bar Los Angeles' Clean Trucks Program from forcing companies to replace owner-operators as mandated
Los Angeles,CAL,USA -The Associated Press/Press Telegram/Transport Topics (only subscribers) -30 March 2009: -- An appellate court ruled Friday that a temporary injunction should be granted to halt part of a plan aimed at reducing pollution at the Los Angeles and Long Beach ports... The 9th U.S. Circuit Court of Appeals remanded the case back to U.S. District Judge, Christina A. Snyder, who rejected a request last year for an injunction by the American Trucking Associations... Under a temporary injunction, the ports would be unable to require harbor trucking companies to replace 20percent of their owner-operator drivers with employee drivers by year's end, as the Port of Los Angeles had mandated. The Port of Long Beach did not have that rule in its plan... Los Angeles Mayor, Antonio Villaraigosa, said the court's ruling doesn't change the program's main components - a ban on trucks with high emissions and fees levied to reduce pollution...
