TRUCKING INDUSTRY * USA - LA judgement finds company violated trucker rights
The attorney general's office says the judgment marks the fifth lawsuit it has won against trucking companies for similar violations
Los Angeles,CAL,USA -The Trucker, by Kevin Jones -5 Feb 2010: -- A judge has found a trucking company operating out of the ports of Los Angeles and Long Beach violated its workers' rights by misclassifying them as independent contractors... The Superior Court judgment announced by the California attorney general's office on Thursday found that Pacifica Trucks avoided paying state taxes by misclassifying the workers. Prosecutors say that means the workers were denied Social Security, Medicare and workers' compensation benefits... Pacifica Trucks was ordered to stop the practice and pay a $5,000 penalty. The company's attorney, Mark Valencia, declined to comment... * Kansas - YRC Worldwide Loses $899 Million in 2009

YRC Worldwide narrowed its losses last year and in the fourth quarter, but fierce competition and insecurity over its debt-for-equity swap hurt its business, company officials said today. Shipments and tonnage at YRC Worldwide companies declined both year over year and from the previous quarter in the last quarter of 2009... For the full year, YRC Worldwide reported an $899 million loss before taxes, compared with a $1.1 billion operating loss and $974.4 million net loss in 2008...
* California - Trucker Con-way Inc. loss narrows, sales flat
San Mateo,CAL,USA -Business Week -4 Feb 2010: -- Trucking operator Con-way Inc. said Thursday it narrowed its fourth-quarter loss from a year ago, when it took huge write-downs, and sales were flat... The fourth-quarter loss was $1.9 million, or 4 cents per share. That compared with a loss of $43 million, or 94 cents per share, a year earlier, when the company took big restructuring and acquisition-related write-downs... For all of 2009, Con-way lost $110.9 million, or $2.33 per share, compared with a gain of $67 million, or $1.40 per share, in 2008. Revenue fell to $4.27 billion from $5.04 billion...
* Hazmat Registration Fee Could Triple - PHMSA proposes increase on large, for-profit carriers for grant program
Washington,DC,USA -The Journal of Commerce Online, by John D. Boyd -Feb 3, 2010: -- Nearly 7,000 companies that qualify as large, for-profit haulers or shippers of hazardous materials would see their federal annual registration fee triple, to $3,000 under a plan designed to shore up a hazmat training grants program... The Pipeline and Hazardous Materials Safety Administration proposed the fee increase through a Feb. 2 notice in the Federal Register, and told industry participants they have one month to submit comments. The plan would take effect as of the registration year that begins July 1, and allows PHMSA to re-bill firms that have already pre-paid their registrations... Those affected could be large manufacturers of hazmat shipments, as well as large firms that would carry them by highway, rail, barge, ship or even air... * California - Golden State kicks in $20 million for hybrid trucks and buses
Sacramento,CAL,USA -Fleet Owner, by Sean Kilcarr -Feb 4, 2010: -- The California Air Resources Board (CARB) has officially opened its $20-million Hybrid Truck and Bus Voucher Incentive Program (HVIP) this week to help spur deployment of hybrid commercial vehicles on California’s roads... The program – managed by the Pasadena, CA-based Clean Transportation Technologies and Solutions (CalStart) organization, which is comprised of more than 140 firms, fleets and agencies – offers funding incentives ranging from $10,000 to $45,000 per vehicle... CARB said each vehicle purchaser, regardless of the size of their fleet, is limited to a maximum of 100 vouchers and is expected to put up to 800 vehicles on the road on a first-come, first-served basis...
* DC - Airline, Trucking Employment Rise
Washington,DC,USA -The Journal of Commerce Online, by John D. Boyd -Feb 5, 2010: -- U.S. transportation industry employment was mixed in January, the Labor Department reported, as airlines added workers and trucking contracted less than normal for the month, but railroads and marine jobs continued to decline... The trucking industry had 1.203 million workers actually on payrolls in last month’s, Labor said, down from 1.234 million in December. However, when adjusted for normal winter season employment levels, and the fact that trucking jobs usually contract in January, Labor said the industry’s employment actually grew 2.5 percent...
